I turned in a lease 1998 toyota 4-runner on 7/14/2001, and purchase a new 2001 toyota 4-runner. I was notified by Bank One on 12/02/02 that they needed to make arrangements to either pick up my 1998 toyota or me to purchase it. I told them that I had turned that lease vichel in, and payed 9,500 dollar (5,000 in cash and finance the rest into my new car) for early lease termination and over milage on 7/14/01 to toyota mall of ga. I was notified by the bank that they had never been notified, and that the loan was still in my name and I was responsible.

The next morning I call the Toyota Mall of Georgia, and for 3 hours Doug Wilson, told me he didn't have the car that it had been pick-up by Bank one. I then called Bank One back, and they advised me to call the police and report it stolen, because the car was still in my name and so was the loan that I was responsible for. I called The Toyota Mall back and talked with Doug, and told him what I was going to do, and he some how managed to find the car. I called Bank One back, and gave them this information, and they advised me to go get the car.
I called Doug back and told him what Bank One told me, and he said that would be fine to come get the car.

On 12/04/02 Me and a co-worker took off work and drove 3 hours to the Toyota Mall to pick up the car. Upon arrival, my car was sitting at the front door of the dealership, running. I went in and ask to see Doug Wilson, and the attendent said he wasn't there at the time, but Bill Stewman would help me. I asked him why the car was sitting at the front door running, and he said that it had a dead battery. I asked him if he could explain to me what happen, and he said that they called Bank One, but they never came and picked it up. I asked him if he could give me the name of the person that he talked to, but of course he could not. He also told me that I should not turn the car off on the way home, because it may not start back up. I asked him if he would put another battery in the car, but he came back and told me it would cost $80.00. I told him I didn't have that much money with me,

I left the car lot on a 3hr drive back home only to find, they had by-passed the alarm system, because the battery was also dead on the remote control, and thy couldn't disalarm the security system to jump off the battery and was heading south through the middle of Atlanta ga, and hit a bump in the road, and the alarm started going off and the car shut off. I had to weave through traffic to the off ramp with the alarm going off and I couldn't restart the car because the battery was not charged. I had to leave the car on the side of the road, and get into the car with my co-worker and drive 5 miles to ge a battery for the remote control to turn off the security system, and get a pair of jumper cables to jump the car back off.

After a 5 hr adventure home, I also found that the dealership had put 23,000 miles on my car while they had it, it had to have new rotors because they were wore out, a new master cylider, new brake pads, new tires, and the oil had not been changed costing me another $1,200 dollars.

After many conversations with everyone that works at that dealership, all they can say is they don't know how this happen. They refuse to refund any of the money I payed them when I purchased the car, or refuse to pay for any damages that they caused to my old car.

I even talked to the owner of the dealership Shawn Esfahani and explained that I could not make 1,100 dollar car payments a month. I told him, he could check my credit report and see that I pay my bills, but that I would not be able to make these payment, plus it was christmas and I had to spend all my money I had to get this car fixed so my childern would have to do without, and that my husband was a farmer and we depended on banks for a living and I didn't want my credit messed up, but I din't know what we were going to do, because we could NOT pay for both cars. All he done was turn it back over to Doug Wilson whom called me at work and tried to insult me.
He also said that no one had driven the car and he didn't know how 23,000 miles got on the car.

I know it is going to take legal action to fix my situation, but I want to tell everyone I can so maybe this dealership want cause anymore hardship like they have on me and my family.

jackie if I were you I would do this ..most car dealers do not care

Jackie, most car dealers do not care as to what
happens to car buyers just as long as you sign the papers on a new car and take it home.

In your situation I feel you have a good chance for a law suit.

Jackie, Car dealers hate this web site because it helps consumers get the dirty car dealers exposed and reveal their dirty tricks.

It is the job of your dealer do make sure that all paper work is taken care of, and that if they offered to have you drop off your old lease on their lot that they should follow up and make sure that your old car is sent to it's owner being your leasing company.

I also feel that they are responsible for the extra miles on your old lease SUV. jackie I feel that if you get a real shark of an attorney you have a VERY strong case against this sucky car dealer.
