Dave, I had a similiar experience with SMM/Scott McKinney. I filed a complaint and got a response back today with a file number and a person to work with on this complaint. I suggest you do the same. It's on the web.

I also have filed with the IN state attorney General and have a case number assigned. Also sent all documents from Ebay, Paypal and Email's
on my dealings with SMM.
Also SMM has seen this report and said they will sue me for the report that I am deflaming their character. I said I would pull the complaint if they could tell me what is not true.

I filed the first report. I waited for my order and got a runaround on item shipping.
When the item did not ship and EBAY kicked him off I filed a complaint with EBAY/PayPal, they refunded me $200 because SMM did not have any funds available to cover the entire amount. I did not use a credit card(my fault) and cannot get a charge back. SMM was informed of this. I filed with the BBB and the state AG. The BBB this week brought an offer from SMM that they would refund my funds by credit card but if I did not get the funds by then I could get a charge back from my credit card company. As stated I did not use a credit card and SMM did not refund my money to PayPal. This was only a try to get me to accept his offer knowing he was not sending any funds and I could not get funds from a CC company. This was also a try to make him look good with the BBB.
I also filed with the state AG.
Now I am going to file with the "Internet Crime Complaint Center" (IC3). This is a federal agency set up to combat internet fraud, they use the federal law inforcement agencies for investagtion.
I recomend anyone with complaints against SMM on internet sales to file with them.
I have all Emails and letters from EBAY, PayPal, BBB, SMM and the state AG.

Hi Everyone. This is Scott McKinney, owner of SMM Performance Parts LLC from Chesterton, Indiana. I am filing a rebuttal since this report is very inaccurate and needs to be addressed professionally. As always there are two points of views or sides to a story or situation.
In this case, the disgruntled customer has reported his un-happy comments about SMM, since the transaction ended up not being completed to his liking or preference. This customer paid for a product securely using PayPal, where there is buyer & seller protection. There are certain protection rights on PayPal, due to internet fraud and constant dissatisfied customers. Unfortunately, there is no way every single customer can be happy with their purchase or sale. When servicing over several hundred or thousand customers per year, there will always be a few un-happy customers, unfortunately.
In this case, the customer paid using PayPal securely and then began to open a dispute later in time because his product was not received in a time frame in which he found acceptable. Of course, there were extenuating circumstances, as this product had to be directly shipped from the manufacturer; therefore delays were a bit longer than normal. Although, the customer proceeded to become very inpatient and very unprofessional with this transaction, therefore filed a dispute. There were several factors which played a part in this refund process, and PayPal does mediate all transaction disputes. The factors were that, I had already ordered the product from our supplier, paid shipping costs, and would now incur restocking fees, all of which ended up with the customer receiving a partial refund. As I am sure everyone knows, businesses are in business to make a profit, not lose money. This impatient customer with a sudden change of heart would not be the deciding factor on a sale with negative profit. PayPal mediates all transactions fairly and properly in accordance with their company policy. We incurred shipping and restocking fees and the unpleasant and impatient customer did have to adhere to this as well. If this outcome was not appropriate, PayPal would not have decided on such an outcome.
Bottom line, we are a good honest company with the best intentions to supply our customers with great services and great products. I personally run the company and guarantee satisfaction with my customers to the best of my ability. Look forward to doing business with any future customers reading this post, and hopefully all other transactions from here out can be as pleasant as possible!

I sent a complaint to the IC3 and have a case number. I again suggest everyone with problems with SMM on internet sales do the same. One of their questions did I know others that have problems with SMM and Scott, I pointed them to RIPOFF.com and a google search for SMM Performance. I don't know if this will do any good with him but maybe it will stop others from doing business with him. It in the long run will cost him more than refunding our money.
