I walked into Washington Mutual one day to make a withdrawal and they tell me my account is frozen because of a lien by Kirschenbaum and Phillips - a collection agency. They will not give me any supporting information such as a court order or the like. Just the number to Kirschenbaum and the debt name and amount in question. (It is a false debt.)

Kirschenbaum and Philips can't even find me in their system, insisting that I am someone else with the same name but different address and different debt amount to a different loaner.

To make a very long story short, I cooperate with them as best I can including sending them identifying information. I also write them a letter demanding the court papers that allowed them to attack my account. They insist that they sent papers to an address which nobody has ever responded back to them at - but that is the address they insist on using, even though it is obviously a wrong address.

At this point they know already that they have the wrong guy. I even made someone magically disappear, when I caught him telling one lie too many: the next day he suddenly no longer works at that company. Yeah, right.

So my bank account is still frozen (because the amount in the account was not enough to cover the amount they tried to collect), nobody will talk to me or send me paperwork showing a court order allowing any of this. I spoke to WaMu and Kirschenbaum many times.

I did get some sort of a case number at some point from WaMu, but that case number is not a court case number in either the states of Arizona or New York, according to my web searches. Also, according to my web searches, Kirschenbaum has a habit of falsifying information about peoples identities in order to collect money from them.

Can anyone say "trial without representation"? How about "purgery'?

Go into your local wamu branch and POLITELY ask for the executive reponse team's phone number. If anyone can help you with this, they can. I too have had a incorrect collection against me that I had to fight, but nothing this large.
