So I received my reconcilliation sheet from Wells Fargo on the 16th that said I had over a thousand in the bank. I have written several checks and went to do so again today for gas only to have it declined. Odd when not 9 days ago I was told there was a large balance and I didn't write anything to take that balance.

So I stopped by the local branch here and was told that they took all the money out of my account to pay for the overcharge on my credit card (which isn't even tied to my checking account). I was stunned!!!!

Long story short, my kids used my card for a couple of months while they started a business. I thought no issue. They hit the credit limit and we all assumed that they would not authorize any more charges, boy was I wrong. I let the kids know they were close to the limit but continue to use it. After about 2 weeks they came to me and asked if I had called to ask for a raise in the limit because they hadn't declined any charges. I called and was told that it was our fault and we should have been keeping an eye on it closer. I asked that they decline all charges from this point and that we would make at least a $500.00 payment each month until the card was back down under the limit.

From that point they began calling me, sometimes 6 times a day. They would not leave messages but I have caller ID. Myself and my son in law talked with the reps at great length to let them know when the payment would be there and were always told the same thing... At this point we were approx $3,500.00 over the limit on the card. We made a payment for $500.00 and then less then 2 weeks later another payment for $600.00 and had committed to make payment under those arrangements until we were no longer over the limit. The rep said that was going to be just fine. Again, my last payment was made 9 days prior to this post!

So as my check was being declined you might imagine what was going through my mind as my pay checks are direct deposit and I have written no large checks written. After a visit to my local branch I was told I was told that even though my 2 accounts were not tied together in any way shape or form that Wells Fargo had the right to take the money for the full over charge on my credit card (almost $3,000.00) out of my checking account and the only thing they would help me out with is 5 of the NSF's related to well more then 5 now bounced checks at $34.00 each.

Is this legal, can they do this? They have now made it so I can't make my house payment, car payment, food or electricity! Especially while I was making payments to them????

They absolutely have the right to do that.

This is called "offsetting" and every bank and CU will do it. They reserve that right in the fine print of the contract you sign to open an account. Any bad debts you have with the same bank can be covered by siezing money from any or all of your deposit accounts.

Without a written agreement to let you pay $600 per month on the card, they are still going to consider it to be in default. Yes the rep said "that'll be fine" on the phone, but unless it's in writing it didn't happen.

If the credit card is now paid up and under the limit, they should not be taking any more money from your checking. Be glad that they forgave the overdraft fees. That's more than they had to do.

You should open a new account at a different, unrelated bank and having your direct deposit done there instead. Once you have bad marks on your credit file it can be hard to open bank accounts. So get your backup ready and get out of WF.

They probably had the right to do that.

Buried away in the documents they gave you when you opened your account they probably mentioned the right to offset from other accounts that you have with their institution.

But the real reason this happened is that you let your kids use your card to several thousand dollars over the limit in the first place! They should have been paying it down, not you.

It sounds like the person you spoke to at the bank was understanding. Generally if you tell them that you let someone use your card, they will tell you that you are 100% responsible for any fees associated, including the ones that came from the payment overdrawing your account. So at least they took care of those for you, because normally they would not.
