The reason I am posting this complaint is to let you know of the bad business practices of Deer Valley Watersports, Ryan Martin and Kenny his sales person.


Before posting this complaint I sent them a copy of this complaint and asked them to take the necessaries actions to avoid this matter to go public. As they did not answer me I posted the complaint on ripoffreport.com.


Deer Valley Watersports (located at 22444 North 19th Ave. Phoenix, AZ 85027) trade in my old boat bayliner and promised me to give me a pay-off check of $10,000.00. As there was this economy crisis and Deer Valley Watersports had no more credit line they asked me if I would accept monthly payment of no less than $1,000.00 and the balance when the boat would be sold. Kindly, I did a notarized promissory note that they signed. All was fine till I found about the sale of my old boat. I contacted Ryan Martin (The broker of Deer Valley Watersports) and I asked him about my balance check. So, he gave me a check of $4,133.75 on August 13, 2009 for the balance of the pay-off of my old boat. He asked me to wait to be sure he had enough money on his account and I waited. When he told me to run the check at the bank I did so.


This check was returned twice with insufficient fund on August 21. We (me and my wife) contacted Ryan and he told us that he would get us a cashier check. But we did not get anything. So, I went to see a lawyer that wrote him and asked him to send me a cashier check. After sometime he told us that he had also bad checks and could not pay me but he was still working on something to get my money.


So with the advises of the lawyer, I wrote a consumer fraud to the Attorney General. I wrote a complaint to the Better Business Bureau of Arizona. I also filed a civil suit that was served. I sent him a Notice letter after seeing the Maricopas County Attorney’s Office Check Enforcement Program before I might be able to file also complaint with this bureau. Today I am waiting the required legal time before I can go on( I have already sent the default jugdgementnotice and then I will do a writ of garnishment). I am trying by all means to get my money back because I need to pay my loan back on my old boat that was sold by Deer Valley Watersports.


I want also to say that after seeing the Fish and Game department my old boat can be repossess at any time by my bank (lien holder). So may be the new “owners” will read this complaint and they will contact Deer Valley Watersports to try to also solve this matter. I do not want them to be depossessed of the boat, they are not responsible for this issue. But if this matter is not solved it might happen. So sooner I get the money, sooner I can pay off my loan and my bank will not take any actions. My old boat is a Bayliner boat cuddy cabin 2001 (Hull ID BIYB23CNJ001) and the trailer is an Escort BT (Vin# 405120DA71). I have all the original document and legal document with me if you ever need them. Thank you for letting me posts my complaint.

Important update on Deer Valley Watersports

Thank you to Ripoffreport.com Your web is very powerful. Deer Valley Watersports saw the complaint and contacted me straight away.


We had a long talk and it seems we are going to get an arrangement. They did write a check and it bounced because they had also a bad check of $8,700.00. They are trying to get their money back and have a writ of garnishment against the person that wrote the check. But they told me that they do not believe to get the money, and they will get the boat back that they will have to sell again.


At this time they do not have any way to pay me back, but they are proposing me monthly installments and paying the finance charges of my loan. They said they never intended not to pay me they just could not do it.


I proposed them to go to mediation for the civil suit and set up a plan to the mediator to have Deer Valley Watersports paying for my loan and finance charges till they can reimburse me in full. That was the agreement we settle down today and I believe that in this harsh economy they really have issues. Again thank you RIPOFF.REPORT and I will let you any of any updates on this case but at this time we have to get back Deer Valley Watersports in good business.
