DO NOT give them your credit card information.

We used Expedite for 2 different email marketing sends for 2 clients (I work at an online marketing firm; however, we don't have large email lists). Everything seemed great throughout the process...affordable, good service, ok results (if they weren't manufactured), and so forth. After our first time using them, we used them again a month later.

Anyways, over a month later our Credit Card company flagged an attempted $475 charge from Expedite. We called them, finally got to talk to a manager because David Pierce was "out". He's been out of the office every time we have tried contacting him...I don't think he exists. Plus we called at 2pm and he was still "out to lunch". Push come to shove, we got lucky the charges never went through but now have the pain to close the credit card account.

The information provided by the alleged consumer's complaint is not sufficient for us to formulate a proper response.

The complaint contains merely inflammatory legal conclusions and is completely devoid of any examples of specific fact or any identifying information that would allow us to determine who this alleged consumer is or what the basis for their claim is. In order to give a meaningful response to any consumer's claim, at a minimum we need to be able to examine the alleged customer's file, see what kind of product or services they had contracted for and determine if all charges were made in accordance with the existing contracts.

The company does not continue to charge a customer, if they stop using its products and/or services and cancel their account. Assuming for the sake of argument that this is an actual customer's complaint, and is not simply a mean spirited attempt by a competitor to anonymously damage our reputation, the customer most likely had a monthly service account that they did not properly cancel. The Terms of Use for our monthly broadcast accounts are located at http://www.expeditesimplicity.com/terms.php. Every customer is required to read and agree to these Terms of Use before submitting their order and again before accessing their account for the first time. Every customer is also required to read and accept the Terms of Use, before accessing their account after an update to the Terms of Use. As you can see the Terms of Use provide as follows:
Costs of Services:
• You agree to pay us a set monthly fee for the right to broadcast up to a specific maximum number of prepaid emails per month using the Services. The maximum number of prepaid emails you are allowed to send and the monthly cost for the Services was disclosed to you on the pricing page of our website and then selected by you when you registered for the Services. Your monthly fee will be automatically charged to your account and paid by you, in advance, until this Agreement is terminated and your account is canceled, regardless of List or account activity and/or use of the Services. You understand that an electronic record of your signup, including your acknowledgement of having read and agreed to be bound by this Agreement, was generated at the time of your signup.
Furthermore, the Terms of Use also provide:
Termination of this Agreement: We may terminate this Agreement at any time, with or without cause, and with or without notice. In the event that you would like to terminate this Agreement, you agree to send such notice of termination via email to cancellations@expeditesimplicity.com. Your termination of this Agreement will be effective upon the last day of the month in which Provider receives such notification and must be received by Provider at least five (5) days prior to your next month's renewal date. You agree that if your account is terminated prior to the expiration of the full term, you will not be entitled to any refund for the unused portion of the term.

In rare instances, it is possible that the company may make a mistake. When such a mistake is properly brought to the company's attention, it is corrected. (PLEASE NOTE - filing an anonymous complaint on an internet site does not properly notify the company of a potential error. Rather, notice of such an action may not ever be brought to the company's attention, does not provide us with sufficient information to determine what if any error may have occurred and, thus, makes it very difficult to correct.)

Here, we note that the alleged consumer mentions only a single possible errant charge that they admit didn't go through. They do not claim that any additional charges were made and offer no rational reason for cancelling their credit card.

As for their alleged failures to contact Mr. Pierce, we would need to know more about the dates and times that they tried to contact him in order to respond. Furthermore, we are not certain what if any kind of message was left for him and given the fact that their complaint was supposedly about a single allegedly errant billing, it may be if a message was left for him, he simply forwarded the message to accounting whom then cancelled the charge.

Bottom line is, without additional information we simply do not know what if anything really happened here.
