On January 15, 2007 I was at Dr. Paul Berger Dental Clinic for a scheduled filling of two teeth. After the treatment, I was asked to pay US$90.00 as my co-payment. I asked the billing secretary to give me a printout of the charges and it alleges that the entire treatment is for $194.00 and thus the balance of $104.00 is to be billed against Delta Dental, my insurer.

On February 5, 2007, I received in the mail a billing from Berger Dental Office office alleging that I owe the amount of $230.00 plus an interest charge of $4.39 for a total of $234.39. I called Berger Dental Clinic to remonstrate about this matter and spoke to a a certain Judy Jacobsen. When I told her that the bill is in error because I have a printout to prove that for my part I have fully paid my co-payment, she said I would have to give her that printout to prove my claim. I told her that she is in error and that this is not the first time, my billings have been in error and inflated to my disadvantage. I, therefore, warned her that unless she makes the necessary correction, I would recommend to my office's benefits administrator and our insurer that her dental office be stricken off the accredited dental offices to be patronized by state employees. At this, she said : "You do that Sir, but you still owe us $363.00." Again she inflated the amount even above the inflated billing I received on February 5.

On February 7, 2007, I received an advisory notice from Delta Dental that they have paid for the dental procedure done on me at your office and that my co-payment is only $32.00.

PREMISES CONSIDERING, it is obvious that I was overcharged the amount $58.00 (FIFTY EIGHT DOLLARS) that by Berger Dental Clinic ($90 minus $32).

On February 7, 2007, I received a notice from the Berger Dental Clinic signed by their insurance coordinator, Judy Jacobsen, that I still owed them some money and if they do not receive payment from me on or before March 1, 2007, they will turn it over for collection to their collection agency. They are still insisting that I owe them $234.39 when as a matter of fact that Delta Dental informed me in an advisory notice that the dental procedures performed on me cost only $160.00 with my co-pay as $32.00 while they had already paid the balance of $128.00 to Berger Dental Clinic. I have all the original evidentiary documents to prove my case. I am an employee of the State of Virginia which provides my health coverage and the actions of Berger Dental Clinic constitutes a manipulation for unjust gain of the State of Virginia's health plan for its employees to the detriment of the State and its employees. Premises considering, this should be a case for the Office of Attorney General of the State of Virginia.

File a complaint to the dental board of licensing or the health dept

They do take that stuff seriously and if you have all documents, then it should be no problem. A dentist I golf with had an incident where a patient saw a stack of outbound statements that contained the name of a neighbor. Apparently, the patient commented to the neighbor about his past due billing. This guy, WHO HAD'ND PAID ON HIS ACCOUNT for a long time objected to the state board about patient confidentiality and my friend had to respond to the board that the info wasn't freely released and it was simply happenstance that someone he knew saw it. Then my friend actually had to respond to the complaintant that it wasn't intentional and was not looking to shame him, even though this guy was essentially a deadbeat customer.

Now Berger Clinic threatens me with collection agency

On February 5, 2007, a Judy Jacobsen presenting herself as insurance coordinator for Dr. Paul Berger Dental Clinic sent me a very nasty letter threatening that if I do not pay the alleged debt of $234.39 by March 1, she will turn over my account to a collection agency. Obviously, the veiled threat is that this will damage my credit rating. This is a very familiar and often effective tactic used by mulcters to scare their clients into paying non-existent, inflated or even previously settled debts.

For my part, my state provided insurer, Delta Dental had already advised me through a printout of their transmitted payment that the procedure done on me at Berger Dental had already been settled as of January 31, 2007 only two weeks after my treatment on January 15, 2007. They said the treatment cost only $160.00 and paid Berger $128.00 leaving $32.00 as my co-payment. Not only had I settled my co-payment as of Jan. 15, 2007 immediately after my treatment, I was asked to pay more than my due co-pay because I was charged $90.00. So the fact is that Berger Dental owes me $58.00.

But here is this Judy Jacobsen still insisting that I owe Berger Dental the amount $230.00 as of January 31, 2007 and she reiterated that this has not been settled in her letter of February 5, 2007. Moreover, she has added the amount of $4.39 to this as late payment interest or surcharge. I know of insurance companies, particularly those handling group insurance, that do not pay doctors for months until they have a substantial number of group claims to settle. So I do not understand why this Judy Jacobsen of Berger Dental is hopping mad about not being paid on time and why she insists on charging me more than what is due them.

Well, I sent them a letter of my own telling them that unless they admit that not only do I not owe them anything but they overcharged me, I was going to file a complaint before the Office of the Attorney General of Virginia to prosecute them as what they were doing was detrimental to the employee health insurance system of Virginia, and hence against the interests of the State.

Well, what do you know, I immediately received a call from them that a check from their office in the amount I overpaid, $58.00 along with my dental X-rays were in the mail and I did receive them two days after.
