Just minutes before I arrived at the gas station, I had purchased a 1.25 gallon-capacity gas can from the Home Depot just up the street. I pulled into Garden State fuel to the far pump on the left side of the second row of pumps. The posted price was $3.87/gal for regular gas. I told the attendant I wanted just 1 gallon of regular and I would be paying cash. I was very surprised when I saw the digital display on the pump pass well beyond $4.00, and finally stop at $5.53 I expressed my confusion to the attendant and asked him how, if the container (which wasnt even totally full) only holds 1.25 gallons, did he manage to pump in over 1.42 gallons of fuel into it. He seemed annoyed at the question and laughed nervously. I told him I only wanted $4 worth of gas and that would be all I would be paying him. I handed him four one dollar bills and asked him if he knew of any malfunctions with the pump's digital meter.

He glared at me with a nasty look, and walked away to help other customers. I called out to him, "Are you even going to answer me?" and he completely ignored me, so I left.

Call the State or Local Department of Weights and Measures

You may want to call or write the local or state department of weights and measures where this took place. Look on the pump for a sticker that shows the pump calibration and it will tell you who did it (local or state) and they can look into the situation further. I'm in Illinois and pumps here all have that type of sticker and traveling for work, I have seen this on pumps in other states.

The pumps here are SUPPOSE to be inspected every 18 months unless someone files a complaint, then they're suppose to be inspected within a week or ten days. File the complaint. Local tv station did their own inspection and 25% of the stations they inspected weren't legal. The way they inspect them is they fill a 5 gallon tank and the pump can't be off by more then a couple of tablespoons. THAT'S the legal limit here.
