Boeing Wichita Credit Union seized my 1994 Honda illegally September 12, 2002. I'm co-owner/cosigner on this vehicle for my daughter, she was a minor at the time. When my daughter fail to maintain her payments I continue to meet my obligation and took control of the vehicle. The car is registered and tagged in my name. I was informed after the fact that my daughter was granted a signature and Visa credit card from the credit union and she fail to make payment on those loans. I'm not a third party to other loans my daughter has with this union.
The accounting representative begin calling my workplace and home leaving messages for me regarding these other loans. My daughter is now 18 years old and I'm not responsible for her debt.
The union later sent me a fraudulent notice of consumer right to cure of required payment. The notice content "you are late in making your payment(s). If you pay the amount due by the last day for payment, you may continue with the contract as though you were not late. If you do not pay by this date, we may exercise our rights under the law. Due date August 26, 2002".
This notice I received is hostile. IF YOU ARE LATE AGAIN IN MAKING YOUR PAYMENTS, WE MAY EXERCISE OUR RIGHTS WIYHOUT SENDING YOU ANOTHER NOTICE LIKE THIS ONE. IF YOU HAVE QUESTIONS, WRITE OR TELEPHONE THE CREDIT UNION OFFICE PROMPTLY.
I called promptly to advise that I'm not late on payment for my vehicle, payment is due August 26, 2002, I paid the payment ten days early August 16, 2002, I've never been late in making my payments and I never received any late notice, as co-owner/cosigner I'm meeting my responsibility as agreed, I have the car, my daughter failed to make the payments, I'm obligated to make the payments and I have, I own and have possession of the Honda, my name appears on the title, car is registered and tagged in my name.
The representative was silent for a second and stated the notice you received is about your daughter's other loans with the union.
The notice did not mention other loans in this notice.
This repossession will show on my credit report per President CEO and Vice President for the union.
The loan officer failed to do their job, no one consulted me that my car would be used as collateral on other loans granted to my daughter or that I would be responsible for paying her debt for other loans.
The loan officer did not complete a background check on my daughter's status-work , income, living. My daughter had moved out of my home and was living independent, working part-time.
This union has no responsible business ethics, have violated me and my daughter.
Disclosing confidential information without a consent regarding their business with my daughter and taking advantage of a young person with no banking experience by the grant of loans that she had no means to repay. Using my signature and credit from loan papers on a car loan that was process over one year ago.
I have gotten no assistance to resolve this violation of my civil/consumer rights.
