THAT'S RIGHT- COUNTRYWIDE SOLD MY CONDO AT A SHERIFF'S SALE BY MISTAKE !!!

Without warning or cause, Countrywide Home Mortgage Finance through their attorney, Trott & Trott, ordered the Kent County Sheriff to sell my home (condo) at the Kent County, Michigan Sheriff's Property Sale.

It was sold on March 22nd, 2006. At the same time, Countrywide reported to the three biggest Credit Reporting Agencies in the USA (Trans_Union, Experian and EquiFax) that my home mortgage had been foreclosed and the property was sold at the Sheriff's Property Sale. Well, they didn't lie. The property WAS foreclosed and sold. The problem was that Countrywide had ordered this foreclosure and sale BY MISTAKE . . . Countrywide's MISTAKE!

The Countrywide attorney, Trott & Trott, and Countrywide itself needed to know that they made a big boo boo. So how do you inform the people responsible that a huge mistake has been made? Very simple answer . . . you just call them and tell them what happened. But oh no! Calling didn't work. Why? Let me tell you . . .

I called the attorney group Trott & Trott in Detroit to tell them that there had been a BIG screw up. The person on the phone introduced himself as a "processor" whatever that is. I told him that my condo was sold by mistake and that I'd like to speak with the attorney who handled the file.

I was NOT allowed to speak with an attorney at Trott & Trott. As a matter of fact not one ounce of energy was spent investigating whether indeed, my condo was sold by mistake.

"Sir, said the "processor" matter-of-factly, "Countrywide gives us the properties they want sold and we see to it that they get sold. We don't control which properties are sold and which are not. You'll have to call Countrywide and ask them. Good-bye."

SO I called the foreclosure department at Countrywide. After waiting the customary 35 minutes listening to the insipid "music on hold" I finally connected with a human being. I told them that my condo had been sold by mistake at the Sheriff's property sale.

"Oh, sir, I wish I could help you," he said defeatedly. "As soon as a property is foreclosed and sent to the Sheriff's sale, all the information about the loan is automatically removed from our data base. I'd love to help you, but I simply have nothing about the loan on my computer. Without that information, I just can't help you. The best thing you can do, is to call Trott & Trott in their Detroit office and speak to them. They can help you."

You get the picture, right? Countrywide to Trott & Trott back to Countrywide, then to Trott & Trott. Of course I got no where with either one of them. So, I just sat there for 6 months waiting to get evicted. I'd tell my story then.

One Circuit Court Injunction and $4,500 in attorney fees later, an agreement was signed by Countrywide and myself, the sale was undone, I paid the back payments without interest, late charges and attorney fees.

Countrywide agreed to undo the Sheriff's sale, write and file the papers at the Deeds Office and to expunge all the data regarding this foreclosure from their internal files as well as the reports on all three credit reporting agencies.

They filed the necessary papers to undo the Sheriff's sale but didn't remove the negative, damaging records from my credit report.

Now here it is July 27th, 2008 . . . almost two and a half years since Countrywide mistakenly sold my condo. The negative information is STILL ON MY CREDIT REPORT.

I stopped paying my mortgage payments because they refused to take the false information from my credit report. Countrywide has sold my condo again, the six month redemption period is over, and I have an eviction hearing during the first week of August.

I won't pay those SOB's another dime until they correct my credit report. I'll have to file another injunction to stop the eviction. Then the gloves come off. I'm going to make sure that Countrywide knows how expensive it can be when treating a client this way. They have violated about 10 different federal regulations involving credit, credit reporting and removing incorrect information from a person’s credit report.

Hopefully, Countrywide will be more attentive to the agreements they sign and the tasks they promise to do.

Any suggestions, similar stories, case law involving Countrywide would be helpful to my cause. Please leave it in a comment for me.
