We also have the EXTREME misfortune to have EMC Mortgage Co. as our servicer. My daughter and I were hospitalized in Feb. 2002. (My daughter was severe) I contacted EMC ASAP to let them know that we would have difficulty making some of our future payments and ask what options we might have. I received no response. I kept calling. I recieved different responses every time I called, and spoke to different people every time, who gave me different answers every time but received no concrete answers, or paperwork to follow promises made over the phone and ultimately no help. I wrote certified letters asking them to assign one person to my account. They responded telling me they needed 60 days (according to RESPA) to research and resolve the problem. I still received no response. They received my letter June 21, 2002. As of today August 5, 2003 I still have no response to my inquiries. They shuffle my calls from one person to the other. They refuse to give me their extension numbers or direct lines. They refuse to give you supervisor names or numbers. They are THE MOST HORRIBLE COMPANY I HAVE EVER HAD THE MISFORTUNE TO MEET!!! They did not hesitate to throw my account into foreclosure demanding all kinds of extra fees etc.
Search on your computer for RESPA (Real Estate Settlement Procedures Act) I can give you a few names I have fought hard to get.

Some inside information:
EMC purchased a larege block of mortgages all at once (They will deny this) They were unable to service effectively all of the mortgages they purchased. They were completely understaffed, this is why your payments were lost, not posted, (some of mine were also) posted late, and escrow payments made late.
EMC tried to outsource many of their departments such as their payment processing center (again understaffed) resulting in lost and payments posted as late as 15 days after being received (I know I had the post office track my mail to prove it was not my fault that my payment was 10 days late.)
Another department they outsource is their customer service department. Sometimes you will speak to employees in Texas but when that center gets overloaded the extra calls are sent to a contract center in NY Ask them where they are when you call 1-800-723-3004. Dana Dillard's Office was responsible for hiring the NY Agency. Call and tell them that your company is considering outsourcing Customer Service ask for Dana Dillard's office, then ask them the company name. You want a referral you hear EMC likes their relationship with the NY Agency. You will speak to her secretary, but her secretary is very informative.
I have not made any headway with EMC in 17 months, but when I told them that I am filing a complaint with the Consumer Protection Division of the Attorny General's Office in the State of Indiana, they let me speak with Supervisors. I told them that I have confirmation on their letterhead that they have received my Qualified Written Request dated Jun 2002 and that as of August 2003 I have yet to receive a response or to resolve my problem and now I have more complaints to file and would like nothing better than to see their doors closed for good!!!
They have just recently ask "What will it take to make you happy?" (I have a faint glimmer of hope, however my true response is, "for EMC to fall off the face of this earth.")
My prayers are with you and your children you have a tough battle ahead. They refuse to admit any wrong doing on their part and any paperwork they send you has a statement to the effect that you agree that they have done no wrong. I sign it only after I place these words above my name

It is my understanding and I am pursuing them from this angle also but I don't have enough information yet, that once I can obtain their charter and organizational structure I can have my debt dissolved by filing suit against them for selling something they don't own. Still working on this one. I don't necessarily wish to "shrug responsiblity" but after one has been put through what I'm sure you've been through, it seems only fair.
