We purchased a mobile home from Oakwood Mobile Homes with a loan through Oakwood Acceptance Corporation in 1995. We have always been ahead on our mortgage by 3 - 6 months in advance in addition to adding extra monies to our regular payment to go towards the principal balance.

We found out that our advance payments were not directly being applied, but that Oakwood was placing them in their bank to draw interest off of our money. Through them doing this, they lost 2 months of our mortgage payments a couple of years ago. When I contacted Oakwood with regards to this, I was on the phone for approximately 1.5 hours with customer service going through each cancelled check that I had in my hand.

The end result of the conversation was that they found the missing payments and that they would correct our account upon me sending them a copy of each check via fax. Two years had passed when I decided to clean out our filing cabinet and decided to have a shredding party; BIG MISTAKE on my part. Oakwood then went bankrupt and sold our loan to Vanderbilt Mortgage & Finance.

Vanderbilt is now saying that we are just barely getting our payments to them on time and I am showing in my records that we are 2 months ahead on our payments. I spoke with Vanderbilt and they say that they need to see our bank records since I shredded all of the checks and the 42 page fax that I had sent to Oakwood with a copy of all the cancelled checks. Hence I had to go to the bank and order 3 years of bank records at $5.00 a statement.

I labeled each check on the statement copy and faxed this to Vanderbilt. Well, Vanderbilt is now saying that since I altered the statement by writing the month that the payment was paid on the side of each statement that they can't accept it. I was then told that they would send it onto their history department and that they would look into it and get back to me. I have yet to this day January 18, 2005, heard back from them.

We are being taken advantage of, not to mention being robbed of two months of mortgage payments and to boot they INCREASED our monthly mortgage payment.

vanderbilt stealing money

i hate this company it is a rip off company. there rude and they lie all the time.. you can fax them something its not good enough. they don't want to solve any of our problems. my loan went to them in 5-01-05. its been in default. i made every payment on the mobile home. its a shame they get buy with this stuff. i think it also a shame the state of texas lets them do this to people. they steal money. i wish i could get back at them for putting my loan in default. i'm a nobody to this vanderbilt mortgage. i have a clayton home luckie me. nobody helps us. nobody real cares. i hate reading what this company doing to all of us. its a shame shame. you can't talk to this company there right your wrong.
