I've made some progress in getting my money back from Fun for Life. Visa recently reimbursed my credit card for the amount owing however it's not 100% guaranteed I can keep it yet.
I phoned my credit card company (pressed the lost card option), asked to be transferred to the "dispute resoloutions dept." I told them that I had made a purchase with my card and that Fun for Life is refusing to refund my money as stated in our contract. Let them know the details of the transaction and everything that has been going on. Ask them to formally begin a dispute and give you a dispute number. They will ask you to mail them a copy of all the documentation including either the contract or the "release form", receipts, credit card statement, and the "cancellation" letter you faxed them (Go in person to FFL and get them to stamp it with the date and a signature to prove you've contacted them in time) or whatever you have.
Visa can begin a dispute for you if less than 3 months have passed since signing the initial contract or receiving the "release form" from FFL as long as there's a date on it. They will give you an address to mail it all to. While they are investigating, Visa will credit your card for the amount owing. They will contact Fun for Life's merchant bank who will in turn contact Fun for Life about the matter. Fun for Life has roughly 4 to 6 weeks to respond. I was told by Visa that FFL CANNOT IGNORE AN INVESTIGATION BY THEIR MERCHANT BANK AND MUST RESPOND. I stress that because as we all know these guys ignore any claim made against them and don't respond to anything. If we have all our paperwork stating FFL must refund our money and that we've made attempts to cancel in the allotted time than I can't see how we would loose.
For those of you that did not cancel in time maybe you can say that FFL failed to give you the services that you paid for and that you want your money returned. Depending on FFL's response or failure to respond, you will either get to keep the money Visa credited you or Visa will take it back from you. That's why I say it's not 100% yours yet until the investigation if done. If you win the case then FFL's merchant bank revokes their right to use the credit card service, that's why FFL has to respond.
Another member in our same situation informed me that the Ministry of Government Services (MGS) will be filing some sort of charges against FFL since they have received several complaints already. It may be beneficial to the case if they know there are more people out there that have been scammed. The person in charge of this case is Mr. Dermot Jennings. Another way we can put these guys out of business is by preventing from advertising in the first place. Contact whatever wedding show or event you heard of them from and tell them that this company is committing fraud. That should stop the event coordinators from letting FFL promote in their venue because they might also be held accountable in a law suit. This will cut off their source of people to scam.
