When we bought the time-share, they specifically told us that if the deal did not meet our expectations, we could just walk away from it at any time without any problem.

After paying almost $2000.00, we call them and said that we would like to cancel and that we were not expecting any refunds, we just simply want to walk away from the deal. Now it seems that we are stuck with this.

They tell us that if we don't send payments they will take legal action against us and that we could lose even more.

Unfortunately we did signed papers. This is definitely a rip-off.
Can any one help?

Did you read what you signed?

What did the papers say about cancelling? Many salespeople will tell you whatever they need to so they can close the deal. The bottom line is: GET IT IN WRITING, AND READ EVERYTHING BEFORE YOU SIGN. As far as getting out of it, I suspect you're out of luck.

In California you have a legal right to rescind (cancel) your contract with any company (except car dealers) within three buisness days of your purchase - AND recieve a complete refund of any monies you paid to them.

This company also has a current judgement against it for just the type of non-cancellation policies you are describing. To read a copy of this State of California judgement against Pacific Monarch Resorts, go to the Better Business Bureau online and type in Pacific Monarch resorts - there are serveral listings for the company and one will have the entire judgement listed. You may see that many of the tactics they used which were deemed illegal may have happened to you as well.

Based on this judgement against them - you may want to contact a lawyer (a lawyer should always give you a free initial consulation), about your options for getting your money back and halting your payments to them. Your attorney will be able to tell you, if and how this can be done.

Current State of CA Attorney Judment Against PMV

Below is part of the Better Business Bureau's report on this company, specifically it is a description of part of the State of California judgement to which Pacific Monarch MUST comply.

"This action represents the third stipulated judgement the Attorney General's office has obtained against this company. All three judgments alleged the company used misrepresentation, and other forms of deceptive sales and marketing practices to entice customers to attend presentations. The current order was stipulated when the Attorney General's office reviewed complaint activity, and determined additional injunctive terms were required.

The company stipulated to the terms of the order without admission of wrongdoing. Under the judgement, the company must make full restitution of all monies paid, rescind purchase contracts and memberships in discount travel clubs, and reverse any negative credit report regarding purchasers during the last two years for buyers who attempted to cancel within 45 days of purchase.

They must also cancel any contract where language difficulties may have resulted in misunderstandings, provide complete disclosures to telephone callers and seminar attendees regarding cancellation rights, and deliver all promotional incentives offered to consumers at the end of the sales presentation. The Better Business Bureau does not endorse, recommend or disapprove of any product, service or company. "
