The Hendow and Albertson case just addressed the issue you have. It was filed prematurly while I was in court. Hendow and Albertson were crooked counselors with the University of Phoenix. However, the government has made a deal to accept University of Phoenix's 65 million dollar settlement. However, as enrollment counselors Hendow and Albertson are thieves collecting liability insurance from their very own bank robbery.
In this mocker is Judge Garlan Burrell, the judge handling this case. You remeber him from the "Unibomber" case. What this means is that for 65 million dollars the University of Phoenix gets away with stealing billions of dollars.
This is based on 20 USC 1088, I am the only one who has addressed this United States law, that requires every university in the Title IV student loan program to provide 15 hours of instruction for one semester credit hour. On a three hour course this means without waiver that the University must provide 45 hours of instruction. Phoenix only provides 20 hours in the under graduate school and 26 in the graduate school, ripping off the government by fraud of over 50% of the entitlements it asks for and even less in its internet school. May be at most 5 hours of instruction for 3 semester credit hours.
Considering in 2009 alone, Phoenix took in 4 billion dollars. As you can see not only did they rip off the government of 2 billion dollars easily, they ripped off the student as well.
Do the math, 20 hours of instruction at Phoenix for their in campus school for 3 semesster crdit hours. On an average bachelors degree of 120 semester credit hours, Phoenix provides only 800 hours but yet charges the government for 1800. Where did the thousand hours go. Obviously to thievery. Keep in mind that a valid associates degree under the Title IV student loan program requires 60 hours of instruction, or 900 instructional hours. I had to put this in to show that UOP is 100 instructional hours short of an associates degree. Judge Briones has been aware of this this thievery, when he falsified the service in my case, refused to allow the government to intervene, and dismissed my case as a private right of action when it was ordered to proceed under the false claims act by Judge Martinez in July 2002. See 02cv0237, and you shall see the original service being made about two years after my case was dismissed. This is docket number 137 if you have pacer. The falsified service was 17 after Phoenix was in default.
The government knows this as well as the corrupted US Attorney's office. But think do we really have a government of the people. No, our government has allowed the crooked banks, who received billions in bail outs knowing that Phoenix cannot be accredited by the Academic year, no matter how manipulated from any accredating agency. So those in ED can get kick backs and that the student loan holder gets the screws.
The California Court gives me service. I know the settlement is 65 million dollars. But it should be in the billions; and all those at Phoenix who have received loans should not have to pay one damn penny back to such a crooked school. The laws says that if the school is not accredited, and it cannot be by operation of law, that no UOP loan holder has to pay back a school that falsely represents itself. Also keep in mind that the University of Phoenix is a SM, a service mark and the word university cannot be used indepently outside in making representation that it is a university.
By law I am entitled to billions. My case is a first of its type and may be found in 20 USC 1088 annotated, 31 Usc 3729 annotated and 31 USC 3130 annotated. However, you see that if there is criminal activity, when it is proven, that Judge Briones allowed Phoenix to rip off the government in the billions and did not order the United States attorney general to prosecute. Oh well, Phoenix is in John Mc Cain country, and some of Phoenix's staff has a member or two that were from the Keating five. Other than river front property in Arizona it is sad that the my beloved government has gone askew and fails the people in this manner.
