it all started with me winning a year at golds gym they would not stop calling me to come in and claim my prize so one day i had a bad cold and they called me again i said fine i will be there shortly. i got to the gym up the street from me and went in the first thing he dose is put me up at the front counter and puts a form in front of me and tells me it is the contest form stating i won the free year and that i need to sign at the bottom so i sign then he asks if i have 20 dollars i said i have no money then he asked to see my wallet i showed him i had nothing then he asked if i hand any change in my car so i went out to my car to see, i was still not in any shape to make a deal with them i took some car wash tokens back in to him he took the car wash tokens and handed me my wallet i then realized i left my wallet on the counter, he then said you are all set then i left thinking ok now what later that day i checked my bank account and saw they overdrawn my account by 40 dollars i went back with my dad he stomped and yelled and they said nothing he could do i had singed the contract. so i let it go it went to my credit report then i disputed it and it was taken off now they are back saying i owe over $1000 and i have been getting rude calls form United Recovery Group one they told me i need to grow up and pay them now or they will cut in to my pay when i get a job, i lost my job due to the down turn and the other time i got a call or try to talk to them the guy just yelled at me and hung up. so i ask is there any thing i can do to get them off me?

You may be able to void your contract legally.

Phoenixred-

If you were 17 or younger when you signed (I'm guessing from your user name and the fact that your father went with you to the Gold's location) you may be able to get out of the contract. In general, you must be 18 or older in for a contract for anything other than "necessities" to be legally binding. If you were under 18, I would have your father write a certified letter, return receipt requested, to Golds stating something like:

Date,

Re: (fill in your account number and/or collection company file #)

My son (fill in your full name) recently came into your location under the impression that he had won a membership at your gym. He was tricked into signing an agreement, and was, in any case, under 18 at the time he signed. As a minor, he was not legally capable of entering into a binding agreement.

If you do not immediately withdraw his account from collections I will pursue immediate legal action against both you and the collection agency.

Please respond in writing no later than (pick a date a week from when you send the letter) with your confirmation that you have withdrawn the account from collections.

I would send a copy to the collection agency by registered mail as well.

If you don't get any results, post here again and I can make some further suggestions.

Another Experience

A couple of months ago, gold's gym started adding $2 to everyone's monthly membership fee. Now I could care less about $2 but now I'm gonna have to take the time to dig out my contract from about 5 years ago and see what it says about if they can jack the price up or not. When I asked the manager at the gym, he said they sent letters out, which I did not receive. I wonder if it's legal or they just went ahead and did it and will remove the price increase on those who complain. Check those contracts people.

i was 18 at the time

hello thank you for the advice but i was 18 at the time but i just got a copy of the contract and at the top where all my info is, is not my hand writing so they forged my info they got from my wallet and put that on there and copyed my debt card
