Lady of America falsified/ changed my contract from a One Year contract to a Three Year contract after I already signed the contract and agreed to a ONE YEAR CONTRACT - NOT THREE YEARS!!! Miami Lakes Florida

Early in 2008, I signed a 12 month contract with Lady of America. The contract stated that I am to pay a monthly fee of about $63 a month for me and my daughter. I signed for a ONE YEAR contract but 10 months out of the contract I could not pay the remainder two months on the contract. (I only paid 10 months of the one year contract) due to personal financial problems. I received a letter from a collection agency for Lady of America. The collection agencies name is called Genesys. The letter stated that I owe 183.30, which is correct, (remember that I owe only two months plus late fees) so a month later I receive another letter from the same agency stating that I owe $2700. I contacted the agency to find out why are the charging me 2500 more than what I really owe. They refused to talk to me and then transferred me to an "investigator". The "investigator" told me that I owe a federal bank 4000.00 for a three year membership for me and my daughter. I asked him how did he come up with that amount and he laughed and said that I signed a three year contract. I asked him to send me a copy of the contract showing my signature. We argued back and forth, he told me even if I really did sign a one year contract that it is the employees word against mine that I signed a three year contract and that I am lying. Then he went on to say, "oh this bank never looses a case so i suggest you pay the 4000.00 or you will be jailed for owing 4000. to a federal bank that financed your contract for lady of america. I think Lady of America should be taken to court by that same bank for forging my one year contract into a three year contract. They took all that money from the bank and now they want to make it seem as if I signed a three year contract when I didnt. I think that these scams are unfair to anyone. Lady of America should have their business license taking away and they should be investigated by the State and/or Government and have an investigator to go and sign a one year contract and then wait a year later when they too will be scammed stating that their contract is three years. -someone really should investigate them and have them closed down for good...Now I have to deal with the threats of going to jail and a judgment on my credit. All over a scam...it is not fair, what do I do? Where is the justice here?

This should be simple

First of all, the collection agency is just trying to scare you. Using bogus terms like "federal bank" and implying that you would be thrown in jail for owing a common commercial debt. Most states did away with debtors prisons in the mid 1800s.

Second, whether or not you signed a 1 yr. or a 3 yr. contract should be easily proved by your copy of the contract. Does it say 1yr. or 3yr? Also, look closely at the cancellation requirements of the contract. If it says the contract auto-renews unless you cancel, that could be where the extra time is coming from. Many people ignore this portion of the contract and do not cancel as required, only to be surprised later.

In short, your copy of the contract should tell the story.
