Company claims to be a Loan Modification Processing Center licensed to do business in all 50 states.  They have collected thousands of dollars in advance from homeowners in distress and failed to perform.  They have failed to refund monies to clients whom they could not do loan modifications for in violation of their contractual obligations.  Additionally they have failed to compensate affiliates and employees upon successful completion of modifications in violation of their contractual affiliation agreements.

FALSE ACCUSATIONS OBVIOUSLY

We will make a brief statement regarding the anonymous claim by this anonymous company.

We are in no way going to be intimidated by an anonymous claim.

We are a modification processing company that does business in the following manner:

1. We do not charge advance fees. We only Charge for services performed and after client agrees with our services.

2. We are licensed Attorneys in several jurisdictions in all 50 states.

3. We have a stellar track record and our Better Business Bureau Shows this as well.

4. We recently TERMINATED certain affiliate companies that done business with us for the following: 1. Fraud with our contracts, trying to collect funds in our name without us knowing etc. We could name them here, but we will not lower ourself to their level of operation.

5. In regards to refunds for clients. We are the processing company: From this anonymous claim this looks to be an affiliate we terminated for FRAUD AND CONTRACTUAL BREACH. All of our affiliates are paid according to the pay contract dates by our Attorneys. We have several affiliates that do good work and will provide the highest level of Integrity for this business. If an affiliate is Terminated for Fraud no monies will be paid to affiliate until all of their clients are finished in our processing system. This is also in our affiliate agreement signed by each of them.

6. Our employees have been employed for over 7 years with us and we have had one individual leave in this time frame to pursue other ventures.

7. We do not publish our success rate, but I can say that we get approved and completed 9 out of 10 clients that are sent to us as long as the client and affiliate give us proper information. We currently have several thousand

8. Also the information the anonymous company or individual left is false. We do not have a website we are strictly a BUSINESS TO BUSINESS entity. They also have our incorrect address and phone numbers.

9. Our affiliate agreements are in Place to Protect the consumer not the Affiliate. If an affiliate chooses to Breach Contract by Changing our contract or conducting business that is in violation of the law then we have no other way to operate but to terminate. WE HAVE A ZERO TOLERANCE POLICY AT OUR COMPANY.

In Summation: If we get a valid claim or slander against our company we will respond accordingly. False accusations like this shows why we operate with a ZERO TOLERANCE POLICY. We are here to protect the consumer, and we have thousands of happy clients in our portfolio. We are not a perfect company, but we learn from our mistakes, and we ensure our clients are protected. Our standards are second to none in the industry and we will put our services record and client satisfaction record up against any other processing company in the business.

Here is a NON-anonymous complaint.

I am one of your "thousands of customers," but I doubt I am the only person dissatisfied with the service. I filed a claim on 1/21/09....that is 426 days ago (the contract said 60-120 days). I filed ALL of the requested papers (within 24 hours) each time they were called for. For well over a year I have been getting the runaround. Your claims about "attorneys" handling each case is misleading; basically what you get is a few paralegals monitoring the "ModTrak" software. Every month I would receive a message stating that there was no update. Month after month after month after month. The bottom line is you guys are capitalizing on the sheer volume of modifications and dragging out the process until people call it quits. ALL of your phone numbers listed on the BBB website have been disconnected and voicemails to personal lines or cell phones are never returned.

In your rebuttal you made it appear as if CCIG was a huge, trustworthy and reputable loan modification company, when in reality all of the "services" you guys provide could be done for free by any homeowner.

You also made the claim that you "do not charge upfront fees," which is odd because I have a copy of a cashed check that states otherwise. $3500 you have received....it's 426 days later and what do I have to show for it?

If you are really interested in showing how great your company is, why not show the kind people of ripoffreport.com how well you handle a refund for a failed modification attempt? I am an honest guy and I understand that you can't win 100% of the time, but your refusal to honor the refund portion of your contract is irritating.

Another Loan Modification Rip-Off Consumer

Dear Counsel for Colorado Capital:  Interestingly enough, I am another one of your "thousands" of clients who have paid for your loan modification services.  However, I am one of the 10% who did not receive a loan modification and have received no response to my repeated requests for a refund.  It is disingenuous of you to claim that you do NOT take advance fees, when, in point of fact, you do - and I have a receipt for $3499 to prove it!  I entered a contract with Colorado Capital on January 27, 2009 for a loan modification, paid my "advance" fee, and received NOTHING in return except denial letters from my bank.  You claim you have licensed attorneys on staff, but I have neither spoken to, nor corresponded with, any attorney at your firm during the months and months you claim you were negotiating with my lender.  The only people I ever had any contact with were your "affiliates", none of whom were attorneys.  In addition, why don't you address the issue of refunds to your clients who did not receive loan modifications instead of clouding the issue by talking about an unhappy affiliate?  I really don't care if your affiliates are happy or not - I want a refund - give me my money back!!!  If, as you claim, you have a "stellar" record with the Better Business Bureau, why do you have a B+ rating and several claims filed against you?  In my dictionary, "stellar" means "excellent" and you are far from being excellent.  Your rebuttal letter claims that the business address and phone number for Colorado Capital were incorrect, how about giving us the correct address so we can contact you?  You entered into a contract with me in the state of California.  Why aren't you registered with the California Secretary of State as a business entity doing business in this state?  Colorado Capital has NOT obtained a loan modification, a rate modification, a payment arrangement or a principal reduction for me.  I am not in default, nor do I qualify for a forbearance agreement, a deed in lieu of foreclosure, a short refinance or a bank approved short sale.  These are YOUR terms for a refund.  Honor your contract and give me a refund.  Counsel, I challenge you to answer this letter, but if you do business like you do loan modifications, it will be months and months until I hear from you.....if ever!

As the original filer of this report I am sad to see similar posts but I am glad to see that it is finally being brought to light.

Just a quick update.  I didn't simply walk away from the matter but it has been a struggle.

I filed complaints with a number of the appropriate entities and got nowhere.  I filed a suit in the courts and worked with the Denver Sheriff's office to find Colorado Capital Investment Group aka CCIG (aka Fischer Legal Services?).  The Denver Sheriff visited their supposed business address and was told "they have not been to this office in over a year".  Another address they use yielded a Fed Ex Kinkos store.  I searched public records for the owner Mr. David Castillo and attempted service at his residence.  No luck there either. 

I hope everyone takes the appropriate action and hopefully eventually they will be tracked down.

Colorado Capital worked for me.

I do not know the details of your experience, but I would like to say that I had success on my mortgage modification with Colorado Capital Investment Group.  The process was exhausting, but it was successful.  I started the process with an affiliate Mortage Modification Legal Network, who then passed me to Colorado Capital.  I submitted my documents to them initially in May 2009.  Over the next 13 months, I had to submit updated documents several times, and even had to submit some documents 3 times.  The problem wasn't with Colorado Capital, the problem was with Bank of America.  My modification file was passed to 4 different departments at the bank during the review.  Every time it was transferred, Colorado Capital had to re-submit my documents.  There were stretches when my file hadn't even been reviewed by anyone at the bank for months, but I still had to send in updated paystubs and bank statements every month!  The end result was worth it though, my mortgage droped from $1865 monthly with a variable APR to $1124 monthly with a fixed rate.  I'm sorry you didn't have success, but I don't feel the problem was with Colorado Capital, the problem is the banks.  They are dragging everything out so long that they think people with give up.  Don't give up! The end result is worth the hassle.
