In result of this it now is costing me 10,000.00 more then it would have becauseof his negligence.Not only that but now that I go to seek another attorney they will not take my case because it is not enough money involved to sue him.Mr James Horland did not do his job as my attorney .
Mr. James Horland was my attorney. The other attorney had come to him in the very beginning of my lawsuit and had offered him to settle my case. In which Ijust found out at mediation in which my attorney said the other lawyer Robert Murphy was a liar..3 days later I found out that my attorney was the liar and found in his notes that an offer was made but it was 500.00 dolars difference in which he never came to me with that offer either. Now that I am trying to find a lawyer to sue him for Malpractice all the lawyers tell me that becasue it only damaged me bye 10,000.00 dollars they dont want to take my case unless it worth 100,000.00. and it is very hard to find a lawyer that will go against another lawyer. This whole thing has made me ill.

I just wanted to write a update on Attorney Jame's Horland. We have resolved all issue's made in this report and I am using him as my attorney. We have resolved all issue's and i would like to have this removed

YOU START BY REPORTING HIM OR HER TO THE STATE BAR ASSOCIATION OF THE STATE WHERE HE OR SHE IS LICENSED TO PRACTICE LAW....
MORE THAN LIKELY, DEPENDING ON THE STATE, THEY WILL MAKE A SUPERFICIAL INQUIRY AND FIND OUT HOW MANY COMPLAINTS HAVE BEEN MADE ON THIS SAME ATTORNEY -- I DON"T KNOW THE MAGIC NUMBER WHEN THEY START TO DO SOMETHING EITHER ... IF THE NEWS MEDIA IS INVOLVED, THINGS TEND TO GET DONE FASTER!
A LOT OF TIMES, WHAT APPEARS TO BE PROCRASTINATION ON THE PART OF THE ATTORNEY HAPPENS TO BE A GOOD BARGAINING STRATEGY!
THERE IS A LOT THAT IS INVOLVED IN A SETTLEMENT.
SOUNDS TO ME LIKE YOUR ATTORNEY WAS JUST TRYING TO GET YOU AS MUCH OF A SETTLEMENT AS POSSIBLE AND I DO NOT SEE WHAT I WOULD CONSIDER EVIDENCE OF MALPRACTICE IN THIS PARTICULAR CASE.
YOU DO NOT JUMP AT THE FIRST OFFER MADE BEFORE YOU FIND THE EXTENT OF THE RESPONDENT'S FINANCIAL RESOURCES AND HOW MUCH DAMAGE WAS DONE TO THE PLAINTIFF... YOU MIGHT SETTLE FOR A SMALL AMOUNT WHEN THE EXTENT OF THE HARM DONE TO YOU ACTUALLY COST A LOT MORE AND WILL COST MORE IN THE FUTURE REQUIRING ADDITIONAL TREATMENT, SURGERY, ETC.
I THINK YOUR ATTORNEY DID THE RIGHT THING, PERSONALLY.
THE LEGAL SYSTEM IS NOT SOMETHING THAT HAPPENS OVERNIGHT OR INSTANTANEOUSLY. IT TAKES SKILL IN NEGOTIATION, THOROUGH KNOWLEDGE OF THE LAW AND ALL OF ITS POSSIBILITIES AND DOCUMENTING WHAT TOOK PLACE SO THAT IT CAN BE USED AS EVIDENCE ONE WAY OR THE OTHER IN COURT.
