I did not receive the item. I opened a case, and the seller responded saying he had sent the item and all would be fine. He never sent the item, and EBAY closed the case as I didn't want to complain anymore if he really had sent. Apparently, he knew this glitch and they closed the case, and the seller is now scot free. I tried to appeal my case, and EBAY refused. Till they correct my issue, I will not be using them. I was one of their first users being a member over 12 years, and they used to protect us, but now, until they correct this for me, I will not be using, there are others that will protect me.

What form of payment did you use? Did the seller provide tracking information?

Power Sellers are catered to by eBay and you will never win. If you don't use PayPal owned by eBay you will lose completely. They have friends and family out bidding you on their junk to drive up the price and eBay cant prove it so they dont care. If you use PP then you will ALWAYS be stuck with the return shipping fees no matter what you do. Most of the time the junk they sell is never inspected and someone just throws the "new" (actually store returns) item in a box and ships it. eBay and their sellers don't care if you are happy or not just return it. Yep at your cost including delivery confirmation or they will say they never got it back. I paid top dollar for Chanel #5 and got something the seller had filled up the bottle with. WAS not Chanel #5. Shop on Amazon.

Read what you wrote in your post........................"He never sent the item, and EBAY closed the case as I didn't want to complain anymore if he really had sent"...............This means that you gave up, and failed to see the dispute process through to resolution.
Ebay always sides with the buyer in item not recieved cases unless there is signature confirmation available, etc. to prove the seller actually performed as required.
Be sure to leave negative feedback on any seller who does not perform as required under the conditions of sale.
As a seller, I ship everything with signature confirmation and also insured if over $25.
This is because Ebay and Paypal both REQUIRE a seller to guarantee delivery of the product to the buyer.
Your alleged "rip off" doesn't look legit.

" He never sent the item, and EBAY closed the case as I didn't want to complain anymore if he really had sent. "
In effect, you closed the case. It's hard to believe you've been on Ebay for 12 years and don't know better than to close an open case. This is not an Ebay "glitch". This is just plain common sense. I don't even use Ebay and I know this.
