OK. This I find amusing.

In a prior RECENT post you complained about a retail store in Scottsdale, that in after 6 months of shopping there, the store employees do not greet you when you come in, and alleged that is due to you being a "person of color". And, you stated that you shop there "because you can afford it". Implying that you are a person of means.

When, in reality, you have bad credit and purchase a car from a lowlife buy here pay here lot in Avondale. Then, you don't pay for it and turn it back in.

You never mentioned what year, make and model of car you bought, nor did you declare the mileage or price paid, or terms.

Keep in mind that you bought a used car. Used cars break down. That is usually why someone gets rid of a car and buys a NEW one. I also would like to point out that the cars these types of lots sell are always sold 'AS IS". No warranty. Or a very minimum warranty like 30 days/3000 miles powertrain, etc.

I lived in Phoenix, and am familiar with these establishments.

If you want a warranty, buy a NEW car. Or save a few hundred dollars and buy a GOOD used car from a private party. Limit your extravagant shopping at the store in Scottsdale so you can save a few hundred or a thousand dollars. After all, you stressed the fact that you "can afford it".

You probably know most of this, but it's for the benefit of others who may read this report. There's a lot of other stuff on government web sites that have better, more accurate information. Visit them.

Before going anyplace else to buy a car, check Rip-off report to see what others are saying.

What any salesman tells you isn't worth the paper it's written on. Get everything, all statements, agreements, etc. in writing. I wouldn't trust a salesman to tell me that repos (or anything) would not be put on your credit report. Of course it will. It's an upaid debt regardless if they run a credit report in advance of the sale.

I thought that a plaintiff was obligated to mitigate damages. That is to sell the car at a fair market price. This prevents them from selling the car to their mother for $1.00 and making you pay for it. I believe they are suppose to provide you with the price they sold it for.

This next item may stop any harassing bill collector. If Ms Gaines keeps contacting you, record all conversations. Protect yourself. Get a phone recorder. When she identifies herself, immediately say "Ms Gaines, this phone conversation is being recorded. Do you wish to continue this conversation?" Get her to identify herself and her exact employment position. She will either hang up or continue the conversation. If she says, "No", terminate the call. Do not continue. If she continues talking without saying yes or no, it's an implied yes. This will protect you legally from recording conversations without their consent. Some states don't require this, but be safe.

Hi steve i'm sorry i left out some details about the car. It was a 97 honda accord with over 132,000 on it. I was young and dumb. The reason i am upset is that they sent me a letter stating the car was resold. So i figured that they got there money for the vehicle. The letter never said that there was an outstanding balance. Yes I have learned my lesson and I did by a new car. I bought a LEXUS!

Cactus Jack's Auto is a wonderful company that is set out to help people get a vehicle when no one else will finance them. We finance customers regardless of credit history, and we DO report our loans to the credit bureaus in order to help our customers establish good credit history.

As with any auto loan, of course it will show on your credit report if you fail to make your payments and your vehicle is repossessed. Calling us and telling us to come pick up your vehicle is considered a voluntary repossession. Instead of acting so harshly, you should have given us the opportunity to fix or replace your vehicle.

When purchasing a used car, you must understand that we DO check the vehicles (quite thouroughly, actually) but you are buying a USED car. Our mechanics inspect every vehicle that we sell, but cannot always find everything that is wrong because they are mechanics, not psychics.

Lastly, I used to work for DriveTime and I can tell you from experience that they do not care about their customers like we do. They give everyone the maximum (by law) interest rate (29.9%), their vehicles are far less reliable (some even have water damage from the hurricanes) and their vehicles have an average markup of $2,000 to $5,000 higher than Cactus Jack's Auto, for the same make/model/year.

As far as the salesman telling you that we couldn't report if your vehicle was repossessed: We apologize that you somehow misunderstood what you were being told, but no one that works for our company (past or present) would say something like that. It's bad business. Why would we ask for your social security number if we weren't going to report on your loan?

Please be more considerate in the future before slandering a company. You need to make sure that you are in the right, and the company is in the wrong. Which is not the case here. You should have communicated with us. You would be surprised on how much we would have tried to help you.

On an ending note, you signed a legal-binding contract that states that you must make your payments. The salesperson and manager fully explained the contract to you. Giving your car up does not break this contract.

Tasha you were not there when i purchased the car, so you do not know what was said to me. There are alot of bad salesmen out there that want to make money so please dont tell me that i do not have my facts right. I have tried everything to get them to fix the car before i gave it back and it was going to cost me almost $1400 to fix the problem. They would not take payments to fix the car they wanted there money upfront. I dont know how long you been with the company but where were you at when i was having these issues?

I also had a serious problem with Ms. Gaines. She harasses and lies to you . She's nothing but an overzealous bill collector. Never ever ever buy a car from this company. Ever.

I have had two experiences with cactus jack auto. one indirect, and one direct.

The direct experience is my wife and I purchased a used car from them. The were very polite, and worked with us on our down payment. They allowed my wife to get the car she loves.

Now, of course the car is not perfect. it is used. It had some problems come up. This is to be expected when purchasing a used car. But I am the one who has to deal with them, not my wife, and this is the reason she is totally happy with her purchase from cactus jacks. And wants to be a life long customer.

We make our payments on time, and no one bothers us. I imagine if one does the same, no one will bother them also.

The indirect experience is through a friend who purchased a vehicle from them. He didn't make his payments. and they eventually found his car parked somewhere in the city. and it was repo'd.

So in closing, keep up your end of the bargain, know what you are getting into when buying a used car, and things will go smoothly.

dont make your payments, or think for some reason you are buying a perfect vehichle, in pristine condition, and it's going to be a rough ride.
