Dear David:
Thank you for your recent
feedback. We have investigated your concerns
and have found the following:
In June of 2010 you purchased a
Q5 from us and added an optional Audi Care prepaid maintenance plan. As clearly stated in the signed agreement,
this maintenance plan is not cancelable. Although we regret any
misunderstanding, all transactions are reduced to writing specifically to
memorialize agreements made between us for a full understanding and disclosure,
copies were provided to you once signed at that time. The non-cancelable feature of this product is
clearly indicated on the agreement which contains your signature.
Regarding the miles on the
vehicle you purchased: in compliance with federal odometer disclosure
requirements, we provided a Federal Odometer Disclosure Form, which you signed
at delivery. This form clearly displays the mileage and is accompanied by your
signature acknowledging the miles that are on the vehicle. Additionally, the
mileage is displayed on the Buyer’s Order, which also has your signature. Copies
of both were provided to you.
We did provide you with alternate
transportation as we represented we would. For certain services where an
extended wait time is required, Audi loaner vehicles are made available upon
request and availability. Please understand that Audi loaner vehicles are
limited and are subject to availability, as we represented.
Finally, according to those
involved with your purchase, a 2011 vehicle was not mentioned by you. In fact, as
we recall, you wanted your Audi before your wife returned from vacation. At the
time, the thought was that the purchase of the 2010 Audi worked well for your
situation, especially since we were able to offer you a vehicle that was in
stock and at a lower price. At the time of your purchase while 2011 models had
been introduced there was little availability of them, given your urgent need
in consideration of your wife’s vacation, you told us the 2010 would work.
We certainly regret any
misunderstanding that may have occurred.
Your satisfaction is very important to us. I would appreciate if you would contact me at
your earliest convenience, so we might discuss this further.
Sincerely,
David Jacovides
