I bought a car from Drive Time, they made a big deal about how they stand by there cars, they lied they sold me a car in December and in January the car has been in the shop four times,n least than a month.  I call customer service and explain the situation, they talk about having a review and didn't call me I had to call them, and they stated that they would pay half, and I need to pay the rest, I told them that they needed to go pick the car up at the shop.  It's been two weeks, and they have not pick up the car.

  I call customer service today (02/03/2012) because the shop call me to asked when was I coming to pick up the car, I told customer service that they were suppose to go pick up there car in that shop because the shop call me.  the lady that I talk to asked several times if I was going to pick up the car.  I said three time no you were suppose to get it, I turn the car in, I no longer want it, it has been reported that I don't want it.  She stated that she saw where it was under review, and asked where the car was I know she knew because each time I call about it, it was on the report that they gave me. 
 
The only thing that they stand by is collecting car payments.  I have not made another payment, I'm waiting to see what they say.  and if they are reading this I want my money back for a lemon that they sold me.  there is such thing as a lemon law.  they need to study it.

Be careful

Unless I'm mistaken, your state doesn't have a lemon law on used cars. Lemon laws typically cover NEW cars not USED cars. When you purchased the car did you purchase it "AS-IS" ? if so, then the car is yours. Did you have it checked out by a mechanic prior to purchasing it? If not you shoudl do that in the future.

Here's what's going to happen if you continue down this path:
1) You turn your car back in and they will put it down as a voluntary repossession.
2) They will sell your car at an auction in an attempt to cover the funds you owe to the bank.
3) The amount of money they raise will be deducted from the amount of money you owe on the car
4) They will sue you for the remaining balance on the vehicle and will put a repossession on your credit.

There is no returning used cars, if you don't believe me go talk to a lawyer in your state. You signed a contract and they will hold you to that contract.

Important question.

    I would suggest that YOU need to study it.   Tennessee does not have a used car lemon law.

    If your intent is to have them reposses the car, that is what will eventually happen.

  That's a pretty general statement, and generally meaningless.   What does count is if you have a warranty that says how they will "stand by their cars".   If so, you need to hold them to the terms of the warranty.   I doubt that abandoning the car at a mechanic is part of the terms.  Proceed with caution.

Going Through the Same

I am going through the same situation with Drive Time. I purchased my vehicle from the location in Raleigh, North Carolina in March of last year. I took my car to have an oil change at Sears, which is recommended, and noticed once the oil change was complete that the vehicle was knocking which it wasn't doing prior to the oil change.

I spoke with Sears Loss Prevention representatives and they determined there was nothing done during the oil change that could have a direct impact on the knocking. I also spoke with a mechanic who had experienced the same with one of his vehicles. He advised me that my situation was just one of the things that just happened and there was no explanation for it.

I took my car to a reputable dealership in town and was advised that I had severe engine damage. I asked what could have caused that. The rep at the dealership stated that the 3.5 engines are built to last forever and that this type of damaged was something that had been occuring over a period of time unless I had been reving the engine.

I am a forty-five year old female and I had no idea what reving meant. He stated reving is when you let the car sit in park and press the accelerator and the rpm meter goes from zero to the redline and then putting the car drive.

Needless the say, Drive Time sent someone to check the vehicle. According to their adjustor, the car was damaged for lack of maintenance. I took good care of my vehicle. It was my dream car. I washed to everyday. I didn't even like it when someone parked next to me.

I have not made my regular payments since this happened and I will not.

You are already having to deal with a sub prime lender...

after a repo, voluntary or otherwise,  you'll likely find No one will want to finance you for anything.

Most sub prime lenders sell cars as-is.

Please cite the USED CAR lemon law for your state, since you've said it exists.

Most states with lemon laws only apply them to NEW vehicles.

I think  it's pretty apparent how you've gotten your poor credit score.

Where Do You People Get These Ideas???

Do you actually think not making your payments is going to somehow hurt them? No wonder you are subprime. I believe the lady named Ashley explained it all perfectly to you. The common denominator with subprime dealerships is they sell tired, high mileage, worn out problem cars. The key to not dealing with them is to take care of your credit.
