Ford Credit is so disorganized that I can see how this happens and my reply is for In My Opinion. We even had repos guys tell us how unorganized Ford Credit was as they repoed our vehicle, that by the way, it was repoed 1 week after we filed bankruptcy. The repo guys totally ignored the BK filing notice that the court sent. They wanted the vehicle and they did not care.
The original poster said Ford Credit commented on how the poster never answered the phone. We were in contact with Ford Credit, husband had talked to them earlier in the day, later that night they called my mother in another state and stated that they could not get a hold of us. I kept a log of all the calls we made, date, time, who we talked to and what was said. I know for a fact that some our calls were not documented, because I would say I talked with so and so at this extension and we discussed this. To be told there was no record of it.
The day after they repoed the vehicle, we got a call from Ford Credit telling us we were behind in payments-we were only 1 behind. I informed this person of the bankruptcy filing, and that they sent repo guys-one of whom physically threatened me-and the Ford Credit guy knew nothing about the BK filing or the repo. So this tells me that Ford Credit does not know what is going on in their departments.
Our BK attorney had the vehicle returned to us. A couple of weeks later we and our attorney got notice that Ford Credit wanted us to sign reaffirmation agreement right away along with a very nasty warning. Attorney said to let them wait because we had a certain time in which to reaffirm and we had plenty of time. We decided that we could not to reaffirm so we turned the vehicle into our local Ford dealer and our attorney notified their attorney of where the vehicle was.
The vehicle sat in the dealer's lot for over 2 months. We got a call from Ford Credit wanting us to make arrangements to turn the vehicle over to them. We knew for a fact that they were again attempting to repo the vehicle--mind you we had turned it in two months earlier. So this again tells me that one dept does not know what the other is doing.
I am filing suit against Ford Credit and the repo thugs. Both of whom violated the bankruptcy stay. Just last week got notice that they are selling the vehicle in a private sale and we will be responsible for any deficiency. Let them try to collect because it was discharged in BK. We will file another complaint with the court for trying to collect a discharged debt.
