I purchased a Mercedes Benz 2008 550 S, "accident free" from Mercedes Benz of Naples this year and discovered later that the car had 2 prior accidents and repairs of over $9,000.00 before I purchased it. When I spoke to the sales manager he apologized for the mistake they made and told me they did not have knowledge of the prior damages. But he also refused to take the car back or to compensate me for diminished value. After approval from the owner of the dealership he told me that Mercedes Benz of Naples will not do anything to eliminate the problem or to compensate me for the loss in value. 
I cannot decide if Mercedes Benz of Naples deceived me or if they are not capable of doing due diligence to ensure buyers will in fact receive an accident free car when they offer one for sale.

You want compensated because the USED CAR you bought was involved in two collisions with a grand total of $9000 damage?  You might want to look a little closer.  There might be small pebbles stuck in the tire treads from one of those previous owners.  I'm sure you'll want compensated for that too!

ALWAYS make them show you the CARFAX!!

I would never buy a used car without looking at a CARFAX report FIRST!

However, I do smell fraud here because I have NEVER seen or heard of a dealership that did not pull a carfax on any premium priced used car.

It is standard procedure. They all do it.

You could sue them for the misrepresentation, and in the process you could subpoena CARFAX to see if that dealership pulled a CARFAX on your vehicle.

Very easy to do.

You can also file a "diminished value" claim for the misrepresentation on the dealership's "errors and omissions" insurance policy, commonly referred to as E&O.

The State of Florida Department of Agriculture and Consumer Services licenses and regulates auto dealers. File a complaint with them, and also request bonding and insurance contact info. You can get this through the dealer services side of the DMV here in FL, as it is public record under consumer protection laws.

You have a valid complaint regardless of what Jim says!

They were aware of it

 They were aware of it if it's reported anywhere at all.  All dealers use Carfax and you should too.  I don't remember what a report cost but it's not much.  Money well spent.

To comments about Carfax report - I relied on the carfax report at the time of my purchase which did not show any prior accident. Only 5 month later the carfax was updated with a remark stating that in some states report accidents only once a year. In my case an accident that was already over a year old finally made it into the carfax report - after the fact. As I see it now the reports are unreliable or worthless. When I buy the next car I will run the VIN through the claims department of my insurance company.

To the smart person with the pebbles. You should see a doctor and get an X Ray, there might be pebbles in your head where other people have a brain. Nobody can compensate you for that problem.

I own two Mercedes Benz automobiles here in Naples and this is why I would never go to the Stealership to service my cars, they are just plain old dishonest. I often get solicited with service department offers from the same Stealership and it just goes straight in the trash. You should have no problem recovering the diminished value in court.
