We purchased a 1999 Mercedes CLK430 for $13,301.00 thru ebay auction #330197771455 and sent the $250.00 deposit via Paypal then performed upon demand of Neil Marcellino, the balance in a bank to bank wire transfer to Colonial Bank of Boca Raton Florida (Clint is the manager at phone # 1-561-368-0072). The title came the next day and we flew to Orlando to meet Neil and pick up the car on 12-26-07 but when we phoned Neil he said he couldn't meet us until 12-28-07. When we met him on 12-28-07 at 10:45am in the parking lot of our hotel, we instantly realized the car wasn't anything like it was advertised on ebay. The auction stated "disappointments do not exist" "4 brand new matching touring radials","100% accident free" "always garage kept" "every item in this car works perfectly". (Read the laundry list of problems with the car in the following paragraphs.)
We immediately asked if this was the same vehicle because it was junk car that looked as if it had more than 200k miles not the 38k as advertised. Neil jumped in a nearby car and sped away. He began calling him on his mobile phone and he laughed as a hung up the phone on numerous occasions!
We have filed a VPP reimbursement report via ebay and after calling the Florida DMV have found out he doesn't have a license to sell cars in Florida. Furthermore, after filing negative feedback on ebay, two other buyers have contacted me with their similiar horror stories! We have also contacted his bank and they refuse to return our money or help us in any way. Today we called Neil at 1-561-674-7755 and he answered the phone. When I asked to discuss the numerous problems with the car he said "call my lawyer at 1-954-568-6900 " but Neil refused to give me his last name or the name of his lawyer. I called the law office and Marsha gave me his last name and said his attorney was Lawrence Wolk. I've left two messages and the lawyer hasn't called me back yet!

I've also gotten the phone number for the previous owner and I'm still awaiting his call as well.
Here's the list of problems we know about and we've scheduled a thorough inspection with our local Mercedes dealer for Monday 1-7-08. We hope and pray there are no other problems:
TIRES DON'T MATCH AND THEY ARE OLD
A/C DOESN'T WORK
2 OF 4 INTERIOR LIGHTS DON'T WORK
SUNROOF DOESN'T WORK
STEERING WHEEL COVERED WITH CUT MARKS AND DAMAGE
WINDOWS ARE HEAVILY COVERED IN CUT MARKS / SCRATCHES THROUGHOUT
DENTS IN FRONT DRIVERS SIDE PANEL
FRONT FENDER DAMAGE ACROSS ENTIRE FRONT OF VEHICLE
NUMEROUS SCRATCHES AND BODY DAMAGE ALL OVER VEHICLE
BACKSEAT ASHTRAY BROKEN AND HANGING OFF
DRIVER DOOR DOESN'T CLOSE PROPERLY/ CAN'T STAY IN OPEN POSITION
SEATS ARE HEAVILY SOILED AND HAVE CUT DAMAGE
DOOR PANELS AND TRIM DAMAGED
These are the basic problems we've found and we're in desperate need of help from ebay and other people scammed by this low-life car salesman.

Paid in Full Without Seeing the Car?

This is a sad story which could have been totally avoided if the buyer had paid the balance in Florida after seeing the car. All he would have lost would be the $250 and since that was paid through PayPal, it would probably have been refunded due to the alleged misrepresentation. I'm sure that if the car had been in Oak Ridge the buyer would have looked at it before paying for it.

The PROOF IS IN and Neil Marcellino IS AN ODOMETER TAMPERING CAR SELLING LIAR ON EBAY! His user ID is "xerojuan" and he's continuing to sale cars on ebay at this time.

Here's the proof:
1) Previous owner promptly phoned me with his story. John Martin of Decorator's Mart in Naples Florida advertised his car for sale. He received a phone call from a man wanting to buy his car. His name was Neil Marcellino in Boca Raton Florida. Neil met John with payment of $8,500.00 in $20 bills. While John was counting all the bills, Neil asked that John leave the odometer portion of the title blank until Neil could take the car back with him and "check" the odometers accuracy! Relunctantly, John agreed but not before asking Neil to sign a bill of sale showing the sales price of $8,500.00, VIN #, and the odometer reading of 70,665 (not the 38,089 Neil later advertised the car for on ebay and fraudulently wrote on the title he sent to me!)

2) We took the 99 Mercedes to our local Mercedes dealership and they have now confirmed that according to Mercedes electronic files, Pompano Beach Mercedes lists the car with more than 61,000 miles back in 2006! We are awaiting the complete service records from Pompano.

3) Mercedes Benz of Knoxville is also providing a thorough list of problems which total more than $3,300 NOT including the extensive body damage!
When I gather even more proof, I'll update!

I've Looked at the Ebay Ad

This car was apparently sold as a Mercedes Certified used car back when it had 8,000 some miles on it. There is a photo of the certification with the mileage on the ebay sale site. There is also a photo of the odometer reading 38,000 something. The photos of the car on the sale page make it look immaculate. The license plate is also pictured. Perhaps these were photos of the car (except for the odometer) when somebody sold it to Martin with 8,000 miles. Was the car that you got red?
How could it have been the same car as the one pictured if it had been beat up?
I'm really curious. Obviously you made a mistake in paying for it in advance but if I had seen those photos I would have, too. The price was very cheap for the car - normally they sell for 20 something.

Bottom line is that odomoter tampering is against the law. You should contact the police down there and file charges against him and then sue him for the difference between what the Mercedes guy in Oak Ridge says the car is worth and what you paid for it.

I also have a rip off report when I bought a vehicle from him in December--My question is when are we going to stop writing about him and do something. I have tried and tried with attorneys here and they say its going to cost way more than what I could get out of him. The truth is if we come together and do somthing we can possibly get him put away. I have done a lot of research on him and to date have about 7 phone numbers and 5 different ebay accounts. I have his partners name and number and was also told to contact his attorney but they were actually willing to pay me off however i didnt accept the money because I want to put this man in jail. I did all the same things except fly there...got suspicious when the title came blank found the original owener through police records and contacted his bank to try and get my money back. Neil told me if I could prove he changed out the obdometer or rolled back the miles he would refund the money and let me keep the car--guess what I have the original ad from the paper that the car was listed in. I am willing to help contribute to hiring an attorney. Call me if interested 479-409-8051. My car was the 1999 Acura if looking through the rip off reports.
