Hey guys, it looks like we all have had it with Ultimate Warranty. If the company does not pay for a claim within 60 days it is a breach of contract (check the fine print). I believe we should all ban together to form a class action lawsuit against Ultimate Warranty. I know there are contract litigation attorneys and paralegals patrolling complaint sites and I hope they can contact us about possibly forming a class against Ultimate Warranty to pay us the full price for our contract plus any owed repair expenses. I bought my warranty through National Auto Warranty Company and all they do is try to shift the blame to Ultimate. That company sold the policy and they bear a share of the blame and expenses.

I was able to get fax numbers for each department in Ultimate Warranty and faxed them demand letters. I also contacted the Ohio Insurance Commission and filed a complaint as well as the BBB in Cleveland. I filed another complaint with the AG in my own state as well.

If you guys agree and if any attorneys or paralegals specializing in contract litigation are interested, we should seriously think about a class action against Ultimate Warranty before they try to file for bankruptcy or some other move.

Trying to figure it out too

So I work for NAWS and we received a E-Mail last week about how we were going to stop selling Ultimate. We are brokers so we need multiple options in each state to sell warranties. So I was a little concerned about why this would of happened.

So after a little digging around on the internet I found out about what was going on at Ultimate from hearing from customers and dealers online. So I start trying to figure out what was going on. From my best info so far this is what I heard.

Ultimate is honoring warranties sold Feb 2007 and on but nothing before that. There backer Capital Assurance Risk Retention Group messed up to my knowledge. I am not exactly sure what is going on but I know it is not good. I know we are still taking peoples money though that paid for warranties that are now useless which sickens me. I am on my way out for sure but trying to get at least at much info I can gather before I go. I will try to keep this updated with any more info I receive.

I truly appreciate your information and I know everyone else does. Sometimes there is a slight glimmer of goodness in people and I am glad it is in you.

I wrote the following to the Cleveland BBB (see below)

"You cannot reach Ultimate by phone. Please send someone over there
To see if they are actually still in business or what the status is on
paying out claims. I have found out that due to so many complaints
against them, your BBB has placed them in an unsatisfactory category.

Please help us who trusted Ultimate and paid good money for a
service we are not receiving."

I recieved a response from the BBB in Cleveland and it was not good. (See below)

"We did visit the company about a week and a half ago and they appeared
To still be up and running. However, they have ceased communicating with us and we fear that they may be going out of business. We have been in communication with the Ohio Attorney General's Office and are forwarding all complaints we receive to them to see if they can be of any assistance.

We have received a flood of complaints regarding this company in the
Last few weeks. I am sorry that we will be unable to assist you.

Please let me know of you have any additional questions.

I was glad to hear that the BBB was really working on the matter, but it seems as if they have exhausted their resources. We all are truly going to have to explore a class action against Ultimate Warranty.

Timothy L. Miller v. The Ultimate Warranty Corp.; David A. Michael Jr.
10/12/2007 CV07638600 Gaul
Complaint for breach of contract, conversion and fraud. Defendant Michael bought out the plaintiff's ownership interest in defendant Ultimate Warranty and executed an employment agreement whereby the plaintiff was to receive annual compensation of $250,000 over a period of twenty years. The defendants have since ceased paying the plaintiff's annual compensation, misrepresenting that his pay needed to be reduced due to a downturn of business. $4.1 million.

maybe someone should contact the attourney that is handling the lawsuit about a class action suit also??
