Valvoline sent my car out with NO oil Rochester New York

I took my car into Valvoline for an oil change in the summer of 2007. It looked like they completed the oil change, they waved me out of the station. While I was driving, I noticed the low oil light was on. I turned back toward the station. By the time I made it there the car was making a clacking noise. I saw much discussion around the front of my vehicle at the station.

It was only because I got out of the car to see what was going on that I realized I had been driving the car without ANY oil. They had not refilled the car with oil. They refunded me the money for the oil change. I said that would not be enough and asked for some documentation that they had sent my car out without any oil.

I then wrote a letter to the national office. Sometime after that a person from the local service station called and asked me to come in for some tests to make sure the car was alright.

Are the tests they want to do for the good of my car or to help them cover themselves?

Go to an authorized dealer for the tests.

I wouldn't let them test a thing until AFTER having an authorized dealer check it out. I would inform them that you're having a dealer check the engine and that you expect them to pay for the testing. Further, if it is determined by the dealer diagnostician that the engine is damaged, you would be within your rights to demand they repair for appropriate repairs.

Be nice about it, but also realize you might very well have to sue them in small claims court for any required repairs. No small claims court I know is gonna expect you to let those folks touch your car again.

I am curious about how you posted

Summer begins in June. It's September now. Did this issue happen the same day the work was performed, or months later? Your post does not really give specifics.

If the issue happened long after the work was done, you have no case.

If it was the same day, you will still need to allow the shop first crack at fixing it. If you do not, the shop will be well within their rights to deny any compensation, and every small claims court in this country will agree. Without the accused shop being allowed to correct the problem, there is no proof whatsoever that the shop did anything wrong.

Look at this way, and this is what the Judge already knows from numerous attempts in the past, someone says a shop screwed up their car and has their buddy(who also owns a shop) make up a fat bill for the new repairs. The buddy says the first shop did everything wrong, and the complainant demands the first shop pay this new repair bill. No Judge is going to accept that as fact, and will tell you too bad.

If you do not allow the shop to do what they have to do, you will not be compensated at all.

One of the people who responded to my post at this website wondered if I returned to Valvoline without any oil on the same day that they supposedly did the oil change. Yes. I was driving home from Valvoline when I noticed the low oil light. I turned around directly and headed back to Valvoline to see what they did that would cause the light to go on.

Why let them fix it?

I don't agree with the other poster about this. If they let you out of the shop without oil then you had better have someone else verify that because, they will just put oil in it and cover it up and NOT fix it. You need to document what was done and have it verified.  I think going back to let them bandage a wrecked engine is a bad idea, you need to get others involved and this person did not know what they are talking about regarding what a judge will and will not allow.
