This company reposessed my 2005 kia rio because of a $40 debt owed to them for an inspection sticker.

The company they hired to recover the vehicle is being charged with reckless damage because thay hit my other car and damaged my son's basketball goal towing the car away. They did not report the recovery to the local police, as required. I have been told they do not even have to file a mechanic's lien to take the vehicle.
The car is in my name only, purchased before I married, and the returned $40 check was written by my husband. This is an extreme abuse of a law. They have "stolen" a car worth thousand's of $$$, for a $40 debt. They plan on selling the vehicle at auction, unless I pay the check fees plus hundreds of $$ in towing, storage and misc fees.

There's nothing you can do about it

They are within their right to take the car. Although unethical, and certainly ludicrous, it's still legal. Why not just pay the $40.00 when the check bounced?

Not to sound crass or anything, but the fact that your bank didn't honor the $40.00 check to begin with tells me that you're in serious financial hurt, and that you've bounced checks before.

Be Careful

There maybe some additional "fees" involved from the state of Texas because they got a hot check for their state inspection fee. What does your husband have to say about all this and what was the amount of time between the time the check was written and the repo'ed the vehicle?

hot checks

hot checks cause a lot of trouble for small business owners. it was not unethical or illegal to repo your vehicle. i know he had to wait for atleast the time for the check to get returned to him, then mail you aregistered letter and then wait 14 days after you signed for the letter to take any action. So if you bounced a check to me at my shop and a week at the bank waiting on registered mail and then 14 days after you got the letter and you still havent paid I would assume you are not going to pay.

His other option he has is to file it as a felony theft of service for the hot check and you would be in much worse shape right now being on felony probation for a hot check that just happens to turn into a felony because even though it was only $40 you stole his services by not honoring your check. I think he could write complaints about you but you have nothing to complain about. you did wrong got your hand caught in the jar and now have to pay the piper. If your anything like most hot check writers you know the check wasnt any good when you wrote it but just thought no one would do any thing abotu $40 what a suprise to you. If this happen more often then either people would stop doing it and stealing from business owners.
