I've had the same problem with BOA clearing a check that was dated 1 day later than 5 debits . This in turn cased the 5 debits to become NSF.. So BOA is charging me 175.00 (35.00 x 5) instead of the 1 for the largest and latest written check. I asked their 1-800 number for a copy of how they clear checks and he got extremely defensive. I had to go into the back , and according to this pamphlet , BOA can clear anyway they want. DO NOT DO BUSINESS WITH BOA!!! SEE LAWSUITS PRIOR!!!

They Can Legally Do What They Want In This Case

CL, you obviously overdrew the account and now you want the bank to fee you on your terms? Sorry, doesn't work that way. It their T&C's you have to live by and if they wish to clear by the largest to smallest, they can do it. More than that, just about every bank out there does this, so your problems won't be solved by switching banks. You will need to either (1) find a credit union where they might be more willing to fee you less to death, or (2) maintain a check register and don't live on the float.

Legally They Can...For Now

Jim is correct. Bandits of America can legally do whatever they want.....for now. But you can count on the FDIC or Congress finally putting an end to their out of control thievery soon.

Until then Cl, the only voice you have is your pocket book. This is where Jim is incorrect. There are a few major banks out there that still do things the old fashioned way - post items in the order they occurred. You just have to do your research, and ask questions to find out which ones they are and I will not name them here to remain unbiased and fair. Once you do find one you're happy with, take your money and run! That's the only language BofA understands.

In the mean time, the Bandits will continue to wreak havoc on yours and everyone else's accounts. Case in point - The new atm fee increase to $3.00. YES, you heard correctly - $3 stinky dollars to get your OWN MONEY! Surprise, surprise. And the profits just keep a rollin on in!

I'll be long dead before Congress or the FDIC do anything substantial.

Besides, nobody needs the government to hold their hands. They should be able to manage their own money. Hell, Congress can't even handle the tax dollars we give, why leave it up to them?

It's pretty simple. Don't rely on the bank to provide your account balance.

Get rid of the check card attached to your account. Use a separate credit card. If your check card number gets stolen, your checking account funds are at risk. Each merchant processes their transactions on differing schedules. The hold on your funds will vary from merchant to merchant which makes relying on the bank for your account balance even more foolhardy.

This is important. Don't spend it until the funds are available. It won't matter how the bank processes your transactions. Read your account terms and conditions to get familiar with how your bank processes your transactions and what their funds availablity policies are. Don't make assumptions. If the bank screws up (and they do) you'll have writen policies to back up your argument. You'll also be surprised at what else you allow the bank to do by maintaining an account with them.

If you decide to change to another bank, get copies of the bank's terms and conditions before you switch. Read through them and select the bank that best serves you needs.

Banks are for profit companies. They need to pay their leases, their employees, their energy usage, their overhead. You know their policies are going to benefit them not the customer.

But then again, don't manage your money. My 401K accounts holds shares of stock in BofA, WAMU, WF and other major financial institutions. The more fees you pay, the better my 401K does. Thanks. Keep up the good work.

Don't Thank Me, Thank The Bandits

First of all you're right about Congress and management of tax dollars. Point well taken but that's a different issue.

No one is asking the government to hold their hands. The request is for the government to investigate whether the charges are outrageous, and unfair and then act accordingly. Just because a practice is legal, that doesn't mean the customer cannot FEEL ripped off and complain. Take gas prices as an example. Why not have everyone stop complaining about rising gas prices and Exxon's RECORD PROFITS and just accept it RIGHT? It's legal!

By the way, don't thank me for your 401k performance because you're not benefitting from any fee profits on my behalf. I wised up long ago and left Bank of America. Many others are now starting to follow suit.

Coincidentally, it's my opinion that this is the "true" reason for BofA's ATM fee increase to $3.00 for NON Bank of America customers. The Bandits realized that as thousands of customers are jumping ship, they can't rip them off with NSF and OVERDRAFT fees anymoroe. But are those former customer now free and clear? Not at all, the Bandits still get the last laugh by increasing the ATM fee for these FORMER CUSTOMERS! And the profits just keep a rollin on in......into your 401k account.
