Hi,

My name is asif and i want to ask what can i do, as i have a account in bank of america, one day my friend and i went to deposit our ay checks in the atm, by mistakenly she deposited my check in her account and then we realized that i still had her check in my hand so we did not deposit that but the next day we went to the bank and told them what happen but they said they can't to anything and will return my check as it would bounce becoz its in the wrong account so we said ok and told them when will we recieve our check they said after 15 working days, but after 4 day i recieved a call from my friend say that the check was cashed in her account.

so i called and asked the bank how can this be possible if they wanted to cash my check atleast the money should be in my account as the check had my name. i did not recieve a proper reply so i want to know can i take some legal action against them.

Solution..

AUTHOR: Robert - Irvine (U.S.A.)

This is not a RipOff. You just made a mistake in depositing the check in the wrong account.

Here is what you do. Once the check has cleared your friends account(which it sounds as if it may have) have them write you a check for the same amount to basically take the money out of their account and put it back in yours.

By the way there is no reason why your friend couldn't deposit their check into their account.

Don't see how the bank ripped you off...

AUTHOR: Edgeman - Chico (U.S.A.)

Accident or not, it is your fault that your check was deposited into your friend's account. The bank didn't force you to do that. They said that they would get you the money, at least give them the chance to return it within the time frame that they specified before filing ripoff reports.

Tell your friend not to transfer, spend or withdraw that money. The bank is probably going to reverse the deposit and she doesn't need to rack up overdraft fees.
