Dec 15th My Account Balance showed $ 52.21

Dec 16th Made a Deposit of $ 243.00 same day proceeded to Home Depot, to purchase some washers.

Dec 16th paid Home Depot by Debit Card $ 4.48 (Deposit summary showed a positive balance of $ 52.21 plus the deposit of $ 243.00. The cashier charged the card and it was not rejected due to overdrawing or otherwise.

The same night a check presented by me for $ 450.00 was cleared and I understand that the $ 450.00 was overdrawn. The Bank switched the transaction and showed the $ 450.00 first to overdraw the account substantially and then shows the $ 4.48 charge, now claiming $ 35.00 O/D item fee twice. Where as when I charged the card with $ 4.48 at Home Depot I had a balance of $ 52.21 plus $243.00 deposit pending. I think I should have been charged the O/D item fee only on the $ 450.00 and not on the $ 4.48. I spoke to customer service and their explanation was this is how the system is programmed and they cannot do anything about it, the larger amount gets recorded first and the smaller subsequently. Should this be according to the time the transaction was carried out. Please help me this is not the only instance the Bank of America have ripped me off, I will bring more fraudulent practices to your attention once this is resolved.

Bank of America is processing transactions in accordance with the account agreement that you signed with them. See page 19 of your account agreement for more information.

Clarification

Unfortunately, this is clearly explained in your deposits agreement with the bank regarding how transactions are posted to your account. These documents were presented to you at the time of your account opening and are sent every year with a copy of their privacy policy. We all need to take time and read about anything that we may not understand so we may better understand our contractual obligation as the owner of the account.

When transactions are posting for the same day this order does apply

credits are posted to the account first, then any bank fees are deducted, then any pending authorizations for goods purchased are deducted, then all posting transactions are posted to the account from largest to smallest

Plus, the bank can not know what paper checks you have written against the account therefore it cannot decline your transaction for something it has no idea is outstanding to the account

this has been a normal function of all account for the past 13 years

Also, If this is your 1st occurance of fees within the last 365 days the bank will definatly help out...but unfortuneatly if this is the 10th occurance or so the bank will not be as willing to help. It really depends on you account history
