Just wanted to update on this case.
I went to My Wamu branch on 9-1-09 to speak to a branch manager in person
We got fraud claims on the phone. They at that time promised to reopen my claim. I called Chase on 9-3-09 to check the status and found that they had not re-opened my claim, but at that time they did promise to re-open it and send me an affidavit.
Fast forward to yesterday 9-9-09, I was concerned that I had not received the affidavit, in the mean time I had to deal with an out-of-state family issue and a computer hard drive that completely died, so I was worried and wanted to follow up. On my 9-09-09 phone call I was told that the claim had never been re-opened, and they would do so now, after I mailed them the sheriff's report. Chase never officially requested the Sheriff's report, not in their initial investigation, not after I asked them to reopen the claim. Wow - not misunderstanding, not miscommunication - straight up LIED to 3 times!!!
In the mean time the sheriff kindly points out that what the Chase Fraud rep was so adamant was skimming was most likely a point of sale PIN compromise. I didn't know any better and I am pretty sure Chase was counting on that. Sheriff was kind enough to sit with me while I discussed possible transactions where PIN compromise could have occurred. There were two. Just today I have also confirmed that chase is charging me for the balance inquiry that was made by the person who stole money out of my account. Lovely.
I also made an official complaint with Comptroller of the Currency Administrator of National Banks, Chase's regulating agency. Chase did not make a good faith investigation of this error, and could not have reasonably reached the conclusion they did from the evidence available. I believe they are in violation of EFTA, and have no intention of ever addressing the fraud that committed against me.
In the mean time, I have reported fraud to the credit agencies, and opened an account at another bank, I have moved all the funds I can right now out of my Chase account, and once my direct deposit is successfully changed over I will close it.
