I made a deposit on Saturday thru the ATM of which only $100 of it was "available". When I checked my balance on Tuesday there were no negatives but I was charged $36.50 for an overdraft.

I called the customer service 800# and she told me that it was because the rest of my deposit didn't clear until Tuesday, therefore I didn't have enough money for a check that went thru on Monday. She said it was because I made the deposit thru the ATM which automatically puts a hold on money so that the deposit can be verified (but as a courtesy they allow $100 to be available immediately). Once the deposit is verified it should be posted to the day it was deposited but for some reason that logic doesn't work at KeyBank.

We argued over the "available" term for quite a while and all she could say was "it was there but it wasn't available". Since, the conversation was going nowhere I decided to change my approached and just flat out asked for her to reverse the charge. She put me on hold then came back and said she could reverse half of the $36.50. I said that was unacceptable and asked to speak to a manager.

The next person came on the phone (supposedly the manager) and he told me the same thing "....it wasn't available....". He said if I had made the deposit thru a teller it would have been available right away. Since they aren't open on weekends that is not possible.

I asked if I know the money was there, he knows the money was there, the other csr even knows the money was there then why were they only willing to refund half of the overdraft fee? He said she shouldn't have offered that at all but he would honor it since she did.

I wouldn't trust KeyBank with your money. I have had this account for about 16 years and there have been times that I screwed up and paid for it. But when they screw up I still seem to pay for it.

Check the Funds Availability Policy

This is posted at every branch, and by law they have to hand you a copy if you ask.

Every bank I have ever looked at states that ATM deposits are delayed by a day. So if you deposited on Saturday (not a business day), your actual deposit date is Monday. Any debit that came in on Monday would have caused an overdraft, even if they did not delay availability until Tuesday.

Depositing through an ATM is convenient, but not if you need quick availability. In this particular example, it sounds like you'd have had to make the deposit on Friday to stand a fighting chance.

You spent money that you didn't have.

You didn't have money in your account when whatever charge that made you negative went through. That's the bottom line. If you go into a store and use your debit card or write a check, then you HAVE TO HAVE THE MONEY IN YOUR ACCOUNT AT THAT EXACT SECOND. That is a fact of life. The bank did nothing wrong, and was even willing to refund you half of the charge. I'd say kudos to the bank.

To answer the people that responded. On the first account, you are right, ATM deposits can be delayed until the next business day. The next business day after Saturday is Monday. The CSR Manager told me that if I made the deposit to a teller I could have asked for it to be posted right away. Unfortunately, most Key Banks (around here) aren't open on Saturday.

As for timing and having the money in the bank comments. I made the deposit on Saturday, I checked my balance online Sunday night and it said I had money. I made a debit purchase on Monday which is the purchase that "bounced".

Suggestion....

Don't assume money's there. Even if it says it. How could that have gone through on a Sunday night?

I had 2 stolen checks trying to go through mine, and that was screwed up for a week on the website. If a person at the bank doesn't tell you directly what you have, you have no argument.
