There are so many lawsuits lining up and being filed against Ocwen these days that rumors are beginning to circulate that petitions might be made to MDL to transfer the ongoing Hartford case to another court.
(MDL is MultiDistrict Litigation panel in Washington, DC. It has the power upon petition to consolidate and transfer cases to ANY Federal judge in ANY state.)
The upshot of this is that the case could be transferred to Oregon or New Mexico. If that should happen, the case might effectively be removed from the lead plaintiff, Mr. Kweku Hanson, and his attorney. It probably will be tried as a class action case ONLY, rather than a RICO case.
I have long been an outspoken critic of the court's handling of the case in Hartford. There is no denying that I feel the court system in general, and Judge Christopher Droney's handling of this case in particular, are responsible for the loss of hundreds of homes over the course of this litigation. Much of this was, in my opinion, unnecessary and showed an unprecedented callousness on the part of our justice system toward victims.
That being said, Ocwen seems to have finally run out of “time-outs” and document exchanges are being done this week. Progress at last! Some predictions are that a preliminary injunction hearing may come about as early as mid-February.
Transfer of this case at this point could only serve to reset the whole thing back to the beginning, “lose” the lead plaintiff, and/or turn this case into a simple quest for money rather than justice. Justice is sorely needed in this area or these crimes will continue across the industry and into the next generation.
A class-action suit at this point will be a “swat on the bottom” for Ocwen and it will cry, kick, and scream for a day or two, then rise up to further victimize all who come in contact with it for years to come. I find it sickening to think that my children or grandchildren will someday find themselves faced with what all victims are facing now.
One way to possibly help avert this crisis is for all participants in this case to send an email to Mr. Hanson re-affirming your desire to stay with the Hanson v. Ocwen action in Hartford, CT.
Don't let these guys ooze away from justice this time as they have so many times before. Don't let them "buy their way out". Justice demands jail time as well as monetary damages. Give them justice!

Robin,
Would you be able to tell me if it is too late to join the class action lawsuit? I would like to do whatever I can to rid our country of companies like them. They have robbed me of my retirement among other things!
I would even welcome to talk with someone regarding Ocwen.

Jodi,
There has been a flurry of activity in this case lately. The fat lady seems to be tuning up, but I do not think she has sung yet.
Here is the contact information for the only person I know who can really answer your question with authority:
Kweku Hanson
487 Main Street, Suite Two
Hartford, CT 06103-3007
email: leagltek@mindspring.com
Good luck to you.

Briefly stated: I agree with Robin's sentiments completely. The already inexplicably delayed case will be delayed for several more months if this class action is moved elsewhere. Also, a simple email to me at LEAGLTKE@MINDSPRING.COM affirming your desire to stay with the Hanson v. Ocwen lawsuit in Connecticut will allow me to pass all such emails to my lawyer to use as a group Exhibit to any comment he makes to the MDL Court.
I will post details when the hearing date and place are scheduled by the MDL Court but the time for ACTION is NOW! Fraud Central does not sleep while we remain passive, but feeds itself by swallowing up our homes, roof, foundations and all.

The MDL process is getting underway, or so my lawyer informed me last night. And every Ocwen and Moss Codilis victim out there, not to worry: no family is being left behind. Overlapping class action lawsuits, including the one in Connecticut (the original and the largest) will make sure that everyone's voice is being heard.

The MDL will be convening in JACKSONVILLE, FLORIDA, on MARCH 23, 2004 at 9:00 A.M. to listen to oral arguments in MDL No. 1604, "In re Ocwen Federal Bank, FSB Mortgage Servicing Practices Litigation."
I am impressed with the speed of this panel's hearing. Maybe there are some judges who could learn a thing or two from it?
If you want your input to be considered, NOW is the time to speak out.

Robin,
Are you saying we should go to Florida to be heard, or send more affidavits, or send more e-mails?

Cyd,
The MDL petition seeks to consolidate the many (more every day, it seems) lawsuits against Ocwen into one huge, gigantic, mega-suit.
The drive here is for victims to try to keep it in CT with Hanson because of the RICO implications of the Hanson v Ocwen suit. Class actions are simply not acceptable in this case. And re-setting the docket at a new location can do nothing but slow it all down, in which case this suit might go backwards!
What is needed at this time is for victims to either email Mr. Hanson to express their desire to keep the suit in CT or letters to the MDL panel telling them the same. This is one matter where victims can and should have a say-so in influencing the panel's decision.
If you will access this Rip-Off Report all the contact information for the panel is there:

Don't worry about going to Jacksonville unless you enjoy wrestling. I think this will be a huge battle among the giant law firms to try to "take control" of all these suits for their own vested interests. And, of course, Ocwen counsel for its own interests.
I do not think victims will be allowed to speak at this one, except in their letters and/or emails, but it might be fun to watch.
If you want to remain in CT, let that be known.
