In case of a single mistake, they backtrack as they see fit to charge maximum overdraft fees. They doctor the reports after the fact to match their claim and deny any wrong doing. On Tueday 11/09/09 I have checked and had only 2 transactions were pending at that point. I had missed a check. On Tuesday morning that check hit and instead of getting at most 3 overdraft fees, I have 11. The check was from an older date. And now all of a sudden that check is thrown in before 8 transaction that I saw cleared on Tuesday. Causing the toal 11 overdraft fees. Looking at the account now there is no way of telling that on Tuesday night the account showed positive with 2 transactions pedning.

This is fraud and treachery. They will not see a single dime from me anymore. You can be sure that I will simulate the same scenario intentionally again. This time I will save the screenshots and printouts. And when they do this again, I will take them to court.

I am sure many became victim of this and just could not figure out what it really is. If anyone have this same experience - don't take it. Customer service wise, they make you feel like a felon for failing to keep track of your own finances whereas they intentionally deceive you.

I am mad but at the same time I do have a plan to catch them in the act.

They think we the people won't protest.

I'm going through the same thing

I can't even begin to explain it, because, as you said the bank back tracks and makes it seem as though you didn't have enough funds for something you did several days ago. My account looks like a complete mess right now. I will admit to three overdrafts because I had a week where there as very little money and we needed necessities like milk, etc. Now those three overdrafts suddenly turned into fifteen... and I cannot possibly explain how. It's not like I was running rampant with my debit card...Since those three overdrafts I had gotten paid and everything should've been fine at that point. I haven't had an account look this bad for quite some time. Suddenly transactions that had long since cleared are now being brought back to the present and the bank is claiming that I overdrafted those and I "know" that I did not. But I can't prove it, and they know this. They have made it so I can't explain what happened but I know it isn't fair and I know it wasn't all my fault. I'm very angry. In a couple days this will be all fixed but part of me is nervous that once it is fixed...will the bank just go and do this again? Since the feds have now passed the new law about banks having to ask permission about od fees (beginning Jan 2010) it seems like this bank and all other banks will probably do whatever they can to pile on the crap between now and then.

I have a solution

STOP relying on online balances, start keeping a check register and balance your monthy bank statement. This will prevent overdrafts!!!

Stop blaming the bank and start taking responsibility for your finances!!!

ps - I do not work for this bank or any bank - I know how to manage my finances through trial and error

I believe you that you do not work for a bank.
I am pretty sure you work for a firm that does online damage control for these insitutions.

I totally understand how you feel. It is a fraud that they are doing and I know they will continue
this practice and I know how to re-create the sceanrio. I am in process of doing so.
I will catch them red-handed before the year end.

Stacey has a valid point BUT

I also think she needs to wake up and take a walk out in this place we call reality.  Times are tough and people are scraping just to get by.  What this bank did to you is an ongoing controversy.  There is quite a bit of ongoing pending legislation about this con game that the banks have going on right now.  Something I think STACEY isn't aware of.

The banks will hold a charge, that they are full aware of, then send a bunch of small litte charges that they are also aware of through.  Then they'll claim that they are doing you a FAVOR by putting through your biggest bills through first and making sure they get paid.  Which completely makes no sense what-so-ever.

First of all, they are going to charge you overdraft fees no matter what order they go through so that is a bunch of BS.  And how they think they are doing you a favor by charging you overdrafts is beyond me.  I would rather pay a $50 late on my mortgage payment, than 11 overdraft charges.  And they know that.

And when you go to the bank, even the bank employees can't sit there with a straight face half the time.  They even know it's wrong.

So STACEY needs to really know exactly what she is talking about before she opens her mouth.  I had a mortgage payment that me and my spouse would have to have paid by the 1st of the month.  Every month in the past, it was sent out as an ELECTRONIC CHECK.  So we thought that it would get sent out on the 1st and we would have the money in the bank on the 2nd.  Well all of a sudden, the bank decides the are going to PUSH our payment through at midnight on the very same day it was supposed to be paid AFTER our balance already showed some smaller POS purchases as having gone through. 

Obviously, STACEY isn't aware of this class action suit that is going through the court system right now as a result of exactly what you are talking about.

This must have happened.

You probably checked the website right as they were updating it. I'm not saying that you're lying, but what you're suggesting USB is doing is hideously illegal and the government would fine them back into the Stone Age if they were actually doing it and/or shut them down. They wouldn't risk that to get a couple bucks out of you.
