i recently walked into a wachovia branch in fort worth, texas to cash my pension check (dawn on wachovia) i was charged $5.00 dollars to cash it because i dont have an account with them. when i pointed out to the teller that it was a pension/payroll drawn on Wachovia, she said " it doesnt matter" - so let me get this straight if I had a Wachovia checking account and i wanted to write a check to "JOE the Plumber" for a $200 dollar job - then i should write the check for $205.00 because otherwise JOE would only get $195.00 that is ridiculous ! PLEASE do not bank with Wachovia and thank America for letting this be legal. If anyody wants to file a class action suit , count me in. Francisco atlanta, Georgia

Pretty much every bank in America does this, so you better make this against every other bank as well. Next time just open a bank account and then they won't charge you. And as far as your "Joe the Plumber" anecdote, you should still pay him only $200, because he probably has a bank account and will therefore not get charged to cash you're check. (How are you writing him a check if you don't have a bank account anyways?)

Every bank does charge you a fee to cash a check if you do not have an account. This is sad but true. You should be glad it was just $5.00 because most banks charge 1-3% of the amount of the check. Sometimes it is good to open an account somewhere and put $5.00 in it and forget about it. The account can't be closed unless you want it to be. I have a lot of accounts myself and if I am broke in one account, I can check my other accounts I have totally forgot about and get funds. Works for me!!!!

I would start laughing but that would be mean.
The reason you have to pay the fee is because nothing in this world is free. The fee is assessed because the entity who runs the account, chose the cheaper account and does not cover that fee for you.
On that note, when you write the plumber a check, he will not get the fee. This is because it is against the law to charge on personally drawn checks. You might as well sue the check cashing agencies that charges fees because according to the law, if a customer does not have an account with the company in question, a fee may be assessed. The reason the check cashing agencies charge higher fees is because they also have to pay that fee but they want to make a little profit so they charge that little extra.
My suggestion, just open the account with $5. Take $4.99 out in a week and now you can cash checks without the fee.
Just remember, if you do not have an account, someone has to pay for the check to be processed and if the owner of the account chooses not to cover it, it is up to the responsibility of the payee of the check.

It is illegal to essentially force anyone to open account or charge a fee to cash a business check. (I know this because i filed the same lawsuit back in 1999 against Fleet Bank now Bank of America, Citizens Bank and Hospital Trust). It is like buying a used TV, and the manufacturer tells you that you must have them repair the TV at their facilities and outrageous prices or you will be sued.

post the case number and court it was held in.
Since you have knowledge of this alleged ruling, it should be no problem to do so. I don't see why you didn't do it to begin with.

The businesses can chose to waive the fees for their employees cashing checks. A lot of them do, and then some of them chose not to, so that person who does not have an account has to pay the 5.00 check cashing fee. It is 6 at BOA and other banks. You do not have to cash it at these places, take it to your own bank, no one is forcing you to pay it. But the banks who do charge are doing so to reduce wait times for their own customers, and it has made a difference!! Too many times us customers have to wait longer because of all the non customers doing transactions. I think its more than far! And if the business you work for does not absorb your fee, get a receipt for the 5.00 from the teller, and take it back to your employer!

I am a new employee where I work, and have opted to take advantage of having my paycheck directly deposited into my bank account (which is at a credit union). However, our first paychecks were issued as paper checks drawn on Wachovia.
Many years ago ( early 00's) we were living in Virginia Beach, and we were warned way back then to avoid banking with this bank, as they has numerous complaints against them for outrageous fees. Today took the cake.
My employer gave us a Wachovia Direct Pay sheet explaining the fees that this bank charges. First in order to open up a checking account ( or any other with them for the most part...unless you want a savings only account in which you can only make 6 transactions per month and get charged a $5 service fee each month.), the minimum you can deposit is $100.They charge $15 if you make a withdrawal at the counter with a direct pay account. I took my paycheck, went to the Wachovia Bank down the road, presented them my printed out payroll check drawn on their bank with my driver's license and my military ID, signed the check and gave the teller a finger print. I was then told by the teller that it would cost me $5 to cash a check DRAWN ON THEIR BANK! I asked for my check back. I didn't take the check to my own bank because the branch was 20 miles away and I didn't have time. Over the years I have cashed many a payroll and even some personal checks with BoA, Sun Trust, BB&T and numerous other banks without ever being charged if the check was drawn on their bank. I work hard enough without having to just give my money away
