on more than one occasion wachovia banks have charged my acct. for nsf fee's when we had money in the bank. i was told by wachovia that they could not use my check that was deposited because it was deposited on the following buisness day. the nsf fee's were charged after my check had cleared. seems to me that if you have money in the bank (no matter where it came from) then you should not be charged the nsf fee's

The NSF fee is charged (posted to the account) the business day after the item was returned. Example: A check for $175 is presented for payment on June 17th. Your balance at that time is $25 (or anything less than $175) and the item is returned unpaid. On June 18 you get your direct deposit in and during processing for the 18th the NSF fee is charged. I understand this can be confusing since the fee posts the next day often after a deposit has credited. But remember the item tried to post the business day before and we can not use a deposit effective on the 18th to pay an item presented in the 17th. Hope this helps explain what is happening.

I just opened an account at Wachovia (waiting for all the fine print to come in the mail) but my question is this. I have direct deposit, and it shows as "processing" today (June 20th). If I wanted to, I could spend down to the last penny of my avaliable balance that has the direct deposit included, and not get charged a NSF fee, correct?

The answer is yes. Your direct deposit will post at midnight of the 20th but the money is available for your use on the 20th. As long as your purchases through debit card, checks and automatic debits to not add upto more than your deposits, you will not get a fee.
A NSF fee is for an item thet is presented and returned unpaid because the available balance is less than the item. Such as in the OP. The item was presented on the 19th and the direct deposit was for the 20th (I know the OP did not mention dates, but this is how it works). Same thing as if the check was presented on the 19th and the customer makes a cash deposit at 9 AM when the bank opend. Money is avalable for use on the 20th, not the 19th. Don't spend the money until it is available in your account.
