I deposited a check into an ATM machine. The check had my name and another persons. All endorsed. After a few days I checked and found the check had been cleared and began writing checks. Several days later I find that the bank had reversed off the deposit as they don't allow these types of deposits in an ATM. They took about 10 days to return the check to me so that I could redeposit it. In the mean time I had overdrafts fees mounting and they refuse to refund them. Everyone at Wells Fargo say that this was not a bank error, therefore they do not have to refund the fees.  I live paycheck to paycheck and to pay those kind of fees that I did not cause is unreal.

I don't understand...

If the check had been "cleared" as you state in your report..then how can this bank claim it was not their error? If they cleared it and then after 10 days tell you they don't allow these types of ATM deposits..then THEY made an error..plain and simple. I would fight this out with the bank...do not give in if your report is accurate. I guess an important question is...was the check good?

A bit of advice since you live paycheck to paycheck. You may want to consider opting out of overdraft protection which I believe your bank now allows.

I do not know how much it would have helped since this may be a bank error situation that they refuse to acknowledge..but it might have saved some fees if you incurred any from debit card use. In other words...any fees you had from transactions that were approved AFTER the bank reversed the check deposit would have been declined if your account was at or below zero. This would have given you the ample opportunity to deal with the issue before any further fees could be charged due to continued use of your debit card. Now if you only use checks and do not use a debit card..overdraft protection can come in handy to prevent addition NSF fees and cover bounced checks..so in that case the service has some merit...albeit it is not cheap

Another bit of advice...NEVER EVER EVER unless someone has a gun to your head deposit ANYTHING into an ATM machine. Always wait until you have the time to hand it to a teller..and get a receipt. Or..cash the check and deposit cash..but NEVER at an ATM. Some complaints here state the bank "lost" all or part of these deposits..which is even worse then what happened to you.

What do you mean your name and somebody else

So were you depositing this check in your account for someone else. Also known as a 3rd party check?

Was it your check or the other persons?

Sounds like you deposited someones elses check in your account and you gave them some money and kept some or was it supposed to be all yours?

Sounds like the check bounced at the other bank and was returned. You should complain to the person who wrote you the check. Not your banks fault. They tried to help you out by making the balance available -- because you live check to check.

I know people that use Wells Fargo and they never had a problem with 3rd party checks in ATM's

First off we do not have enough information to determine with 100% certainty if this is or is not the banks fault..perhaps the OP can share more..

And secondly...there is NO WAY on EARTH you would convince me the bank did ANYTHING to "help" this customer out..that statement is a joke..I will have some of what you are smoking please...

If this bank did anything....it was SOLELY for the intent to charge more fees..unless you think the banks suddenly became un-greedy, ethical and caring and are now a charity organization?. If the customer makes a mistake these days...the customer gets rocked with fees..if the bank makes a mistake..the customer often gets rocked with fees...I see no signs that this bank "helped out" this customer in anyway by making the balance available for an uncleared check..they very often do quite the reverse..which is make the balance UN-available on a cleared check..but I guess they will go either way as long as it can rack up fees and best hurt the customer.

Both.  A check can be written to more than one person.  For example, the IRS makes the refund check out to both people in the case of a joint return.  As long as both people endorse it, there shouldn’t be a problem.

The bank’s policy is the bank’s policy, but the check should have never cleared and the money should have never been made available.  This is the bank’s fault, plain and simple.  If money was made available, how could this person possibly have known that the money was going to be taken away from them later?
