Recently I have had an overdraft on my account that resulted in exorbitant fee. Naturally Well Fargo Bank took the largest amount first and let many $5.00 through $15.00 debits last. This resulted in nearly $250.00 in fees. While trying to rectify this situation I was unable to stop two automatic payments in time which added up to a total of about $345.00.
In the process of trying to work with Wells Fargo I have dealt with extreme rudeness, petulance, egotism and complacency. I have made over 25 phone calls from branch manager to corporate office and all have the same response word for word. Meaning, this is a trained response.Meaning, they know they are getting away with USURY (-noun- The lending or practice of lending at an exorbitant interest rate).
If I were to lend someone $100.00 and charge $250.00 to $35,000,000 in interest, I would go to jail. This is called loansharking. Yes the thirty five million dollars is correct. if you overdraft by on penny and get a $35.00 charge that is $350,000% times $100.00. Why does the American public put up with this. Are we nothing more than sheep to the big corporations. I ask these questions rhetorically speaking. But I am serious. Wells Fargo messed with the wrong person.
Although there are no State laws in Nevada that regulates a national bank, that does not mean we THE PEOPLE can not do something about this. Most states have Initiative and Referenda as a right in their respective Constitution. Obviously the politicians belong to the banking industry as well as most large corporations, so that is a waste of time. We do however, have certain rights to change law.......................
Anyone in the same position that I am in, I have some advice. First file a complaint with the Office of Comptroller of Currency (the only non lawer legal action we have against this type of abuse) if they get enough phone calls, maybe some attention may be paid. Next, if the bank has a right to record you, then you have a right to record them. When they say "this call MAY be recorded for quality puposes", essentially they are giving permission by definition.
I invite anyone who feels they have been unfairly charged by any bank to help me in the start of an organization that will set a standard for every state to regulate overdraft fees to a percentage that is within legal lending practice...........
