Let me begin by saying I am not perfect.  We have been stupid in the past about the use of credit cards and now we are suffering.  My wife who is a daycare provider has recently lost a lot of business becauuse of the economy and kids getting older and going to school.  We live in a small town and the spots are not filling like we hoped they would.  We have lost a significant ammount of income.  We have not been perfect in how we handled this and take responsibilty for that but I need to tell you about Wells Fargo Bank and there gross injustice they have served to my family.  We are a few months behind on our car payment and the Auto Finance department of Wells Fargo decided that they could deduct money from our checking account.  In a way I can understand this.  The thing that bothers me is we had no written or spoken notification that this would happen.  The ammount was 352.42.  So we continued to use our account for small items like a home repair item and groceries and gas.  We then decided we needed to make some payment to our car, got online and saw this debit from our account and guess what, we went from being 360.00 dollars a head to -212.00 in the hole.  If we had known that WF would debit our account we would have not used the account but no we went ahead and used it and now we have been slammed with 5 overdraft fees of 35.00.  I called and said I didn't think this was our error and they "graciously" offered me a 50% reduction in overdraft fees.  I told them this was unacceptable.  I want a 100% refund becasue this was not an error or oversight on our part.  This refund would be 175.00 and I am quite sure that Wells Fargo can continue to run without my 175.00 but in this time my family can ill afford to lose 175.00.  Don't use this bank at all they are thieves.  Put your money in a local bank, period.  Thanks.

you said "We were Several Payments behind".  I am sure that 350.00 did not cover all your payments.    Your mother may have carried you 9 months, but the bank will not

Explanation.

   What you are experiencing will happen at any bank.  Written into the agreements that you signed when you opened your account was the right for the bank to "setoff".  Basically, that means if you owe the bank money on one account, and you have money in another account, they can take the money from the positive account to apply to the deficit in the other account.   As far as I know, this practice is almost universal among banks.

   If you owe money to a bank, your best bet is to not have any other accounts at that bank holding a positive balance, or they will raid it.

Sucks to be you, but as the previous poster had mentioned there is something known as a "right to set off" in the disclosures that you sign with the bank..It is your responsibility to read these disclosures..And if you say that you dont want to read them, that you dont have time and that you think its ridiculous then quit complaining...Maybe if you took the time to read the disclosures this may have not happened..

Explanation

This is called an offset and you will find it in your loan documents.

It is based on the idea that as customer of WF you cannot expect to have money in an account that you hold with them and owe them money at the same time.

Makes sense really.  Why would a bank offer you all those banking services while you don't pay them an agreed amount.

Should have made your payments or applied for a modification.

So the guy made a mistake and wanted to complain to see if anyone could give him some feedback, insight or input.  Not insult.  Read the definition of those words and come back when you can give insight to what had happened.

For Example, here is my INSIGHT/INPUT:

I'm sorry to hear of your problems with Wells Fargo.  But in my experience, it usually states in the contract you signed that they can pull your payment automatically from any accounts tied to this loan.  I know it really sucks, but if I were you, I would take the 50% they offered and open a checking account somewhere else.  That's what I did.  By the way, Wells Fargo does stink big time, and you have to watch EVERY penny as they take advantage of you any way they can.  Good luck!

The only thing these bank defenders have is the cowardly insults and belittling of posters who complain here.

They rarely offer anything but insult.

It is a shame that when someone feels they were ripped off and come here to complain..that instead of a fair rebut by someone from that bank..or offer any real helpful advice..they prefer in their sadistic ways to kick someone when they are down. it is quite cowardly and rude to say the least.

If someone is here lodging a complaint..chances are good they are already upset..already feel bad..suffered financial loss..and may be angry..so I have no idea what they think making them feel "more bad" is going to accomplish..typically they are just here to detour the facts..and/or smoke screen the actual topic of the report.

Either way..whether the Poster is wrong or right..they did not come here to fight with irrelevant cowardly bank defenders..who apparently since they offer no real help..and are not involved in any way with the event..and are not an employee of the bank or branch in question..are nothing more then trolls looking to discredit the poster by insult..for no apparent reason other then personal satisfaction or making the poster more angry...and/or feel worse. I do not see any other motive with MOST of their comments.

It's easy to hide anomalously behind a screen and hurt peoples feelings..but it is of no help to anyone. If a person really has a vested interest in the report either way..the replies would be taken seriously if done with integrity..and simple decent RESPECT...like our parents SHOULD have taught us from day one.

I actually pity some of them..as they have no other purpose in life it seems then to make others feel bad who already do feel bad..I can't think of a name to call that which would be suitable on a public forum..so I will just leave it at that..use your imagination.

This is for public information...a definition...

A ripoff (or rip-off) is a bad deal. Usually it refers to an incident in which a person pays too much for something. A ripoff , is in the eye of the beholder.

Perhaps...but what did it accomplish other then confirming the fact that you are a rude A-hole?

Perhaps your comments would be taken seriously and have some integrity if delivered with simple common respect and courtesy..and not degrading...unless degrading is what you are used to in your life?

No need to sugar coat...just act like a human is supposed to ..you know..the way I assume your parents tried to raise you. Any COWARD can come here and act like beavis and butthead..but it takes a little honor to help someone..or rebut without being a douche.

The OP is already upset..already at a financial loss...angry and feels bad. So you trying to make then feel even "more" bad has done any good for anyone?

Care to explain your shame?

Feel, felt found method

Let me first say i work in a bank that is not BOA as a manager and if any one of those posts was an employee of mine they would have been reprimanded immediately.  When a customer comes in to complain about fees (even if it was their fault) we would never use the language seen in the rebuttals.  There is a wise way every customer service representative should respond.  It is called the feel felt found method.  First we will always start with a "feel" response such as.  Mr. Smith we apologize that this happeneded to you and we feel horrible about your situation.  the we would use felt.  Mr. Smith many customers including myself have felt the same anger and confusion I am sure you feel now.  Now found.  What we have found that may help you in the future is if you make small payments to payoff what is owed but never more than what you can afford. 

 

Now this may sound corny for many of you people who obviously do not like sugar coating anything and would rather make snide remarks to a customer, but I tell you when you sympathize with a customers situation you turn the interaction into a personable experience.  For the original OP I hope you recover from this dilemma and if you need help from someone inside the banking system let me know through the postings here.

...of how someone can be a bank employee..and still treat others with respect and dignity..

Because just as all bank employees are not rude and insensitive..not every customer who incurs an overdraft is an irresponsible idiot.

Unforeseen events happen in life and no one is perfect..but when someone disrespects another for no reason other then personal satisfaction..that in my opinion is a sickness. And whenever I witness someone doing that here..I will strike back tenfold.

Because when someone insults a poster here that is lodging a complaint because they feel they were ripped off..whether they in fact were or were not in YOUR OPINION.....makes no difference..because if you act like a jerk while hiding behind a computer screen anonymously...that is a sure sign of a coward and low self esteem..and you lose ALL credibility by default..even if you may have had something of substance to offer.
