Time after time, Charter One bank holds small checks for sometimes weeks, then, waits for a large check to come through, then, clears all checks the same day starting with the largest check first, making all the small checks subject to insufficient funds at 39.00 fee each. I have even read an article confirming my suspicion in a national magazine. When speaking with the bank supervisor, she claimed that they do not practice this procedure, but after some questions, I caught her in a lie. She then said, well, we do cash the larger one first because we think it is the most important check for you. I said, then why would that matter if you pay everyone off anyway? She had no answer, that's when she became ignorant to me. They refuse to refund any of the overdraft fees and I believe this practice should be out lawed. I am enclosing a law office that I have found that handles class action law suits of this nature. If enough of us write to them, hopefully they will take our case. I see so many people are in the same boat and have read that the bank ALWAYS loses or settles out of court so they can keep on with their unscrupulous practices. Here is the contact info. for the law office.... www.lieffcabraser.com the name of the law office is Lieff,Cabreser,Heimann&Bernstein,LLP
I urge you all to write to these lawyers as soon as possible!
Thanks, Dave
