My husband and I joined the club with good intentions to get more exercise. We were doing the bi-weekly payment thing since we could not afford membership by the year and they offered us a package based on us joining together. This was back in 2006.

We noticed after a few visits that the gym had a leaky roof issue and they had towels around to dry up the water that was on the floor. Within a couple months the problem was getting to the point that the towels weren't holding the water and the equipment was getting we and we were getting wet while using the equipment. Since we are not confrontational people we decided to pay out our year of contact and not renew.

The company was supposed to send out a renewal notice, but neither of us got anything. Once I realized that the year was up, we went to stop by the club only to find out it was closed for renovation! We had not received a letter informing us or anything! Since we were supposed to go by the gym to cancel the membership I called the head office and left messages that I received no call back for.

Since the payments were still coming out of the bank account and they weren't able to provide the service since the building was under renovation I went to the bank and did a stop payment request. At my bank that is good for a year. We received collection notices to pay within 10 days that we received after 10 days was up. There were no contact telephone numbers on these notices. I then called head office again and left messages...no call back.

The renovations finished and we each got notices to come in and see the new location, these were written as if we were not members. That was several months ago, no collection notices since long before it reopened. Then last week, they took money from the bank again!

What am I supposed to do now? I went by the newly renovated location and she said we didn't follow through with the account cancellation properly so its my responsibility. Don't they have an obligation to provide a service?
