Clear Light Publishers In Breach of Two Contracts with Author Santa Fe, New Mexico

Matter 1. According to my author agreement with Clear Light Publications, my royalties are due and payable 90 days following each quarterly accounting period. My books have earned over $500 in royalties from January 1, 2011 through October 31 in 2011 and over $200 in the last quarter of 2010. I have not received any payment for these accounting periods.
Matter 2. According to my investor agreement with Clear Light Publications, my investment of over $20,000 was due in full by February 2011. Clear Light Publications made several payments, some in money and some in books, but still owes approximately $9000.00. My husband and I have sought resolution with the publisher on this matter over the last nine months, but continue to meet many delays and minimal cooperation. Meanwhile, the publisher continues to make money from sales of books I paid to have printed, while not paying me my royalties and not paying off the loan.

Ms. Rose and her husband Robin Weeks are an unscrupulous couple attempting to defame our company with extortive behavior as evidenced by this complaint. Clear Light Publishing (CLP) carried MS Rose from 2004 – 2010 with up to a $7,220.59 balance owed to (CLP) from her royalty account. On or
about July 2010 she and her husband approached (CLP) to publish her new book Tibetan Tales from the Top of the World (TTTW) and reprint her first book Tibetan Tales for Little Buddhas (TTLB). We agreed to do so if they would pay for the printing and promote the sale of the books. They invested $17,880 in the form of a loan with a 15% interest of $2,682 to be paid in 18 months.
Subsequent to our printing and publishing the books, Ms. Rose did not promote the sale of her book as evidenced by the lack of sales.
(TTTW) 1114 copies and (TTLB) 885 copies for two years 2010-11. CLP is holding an inventory of (TTTW) 1378 copies and (TTLB) 1712 copies.
On November 3rd, we sent an offer proposing a settlement whereby CLP would return 878 copies of (TTTW) and 1212 copies of (TTLB) to Ms. Rose and her husband with a combined street value of $41,696 and wholesale value at a 55% discount of $18,768 to satisfy a $9,139.77 balance due.
We prepared a Letter of understanding as a settlement. Over the past two years we have paid Ms. Rose and her husband $11,422 against her royalties and loan.
CLP has acted in good faith in offering Ms. Rose and her husband a settlement for this matter on November 3rd. Which was eventualy accepted.
We respectfully request that you dismiss this complaint.

We stand by our claims that Clear Light Publishers was in breach of both the investor contract and the author contract, and was not forthcoming with a fair resolution or timely responses to our requests for a resolution. While the settlement they finally offered did not remedy their breaches, we agreed to it because we felt it was in our best interest to terminate this business relationship with expediency.
We hope this report helps protect others from being defrauded as we were.
