Claimed to sell DVDs at extremely low prices. The receipt they emailed me said they would not charge my credit card until they ship, and they would send me a confirming email when they ship. They lied.

They charged my credit card 3 days later but they did not ship anything. They sent no confirming email. They charged my credit card for $49.95 but my order total was only $5.50.

I phoned them and spoke with a man with an Asian Indian accent. He claimed that by placing an order for DVDs I had agreed to a membership according to BluBayDVD's "terms and conditions" paragraph 6. However, paragraph 6 is entitled INDEMNIFICATION and it never states that by placing an order for DVDs I agree to a membership.

This paragraph does mention the obligations of someone who agrees to a membership, but never did this. It says that the monthly membership fee is $39.95, but this does not correspond to the $49.95 charge they made.

I told the man on the phone that I am canceling everything with BluBayDVD.com: I cancel my order, I cancel all relationships and memberships with BlubBayDVD whether or I ordered them or not, do not ship anything to me, and do not bill anything.

I then contacted my credit card issuer HSBC and told them of BluBayDVD's misbehavior, and asked them to revoke the charge and block further charges. They had me fax them a written statement.

Note this well: The BluBayDVD.com receipt clearly and simply says they will not charge my credit card until they ship. They did not ship. So, by their own written promise, they were wrong to charge anything to my credit card. This is the basis for my claim to my credit card issuer (HSBC). If you were cheated by BluBayDVD perhaps you can make the same claim to your Visa/MC card issuer.

Now we will see if HSBC stands behind their credit card customers or if they will fail to be responsible.

Note carefully: The company is BluBayDVD.com and it is not BlueBayDVD.com
