My wife and I through our LLC wired $8,750 to Infinity Commercial Capital 9-16-2008 for the purpose of underwriting our financing request of $8,500,000 for the purpose to refinance a loan and structure the construction of a subdivision in Arizona.

The contract states the underwriting deposit fee is refunabable if funding does not occur, except in the case of misrepresentation of information and withdrawing from loan request or failure to didclose or provide requested documents required to secure funding request and once a letter of intent has been provided to the Client. This company was provided all documents required and since last February 2009 we have heard absolutely nothing from them. They wouldn't return phone calls or e-mails. They represent they had a funding partner and were assigning our loan request to a underwriter. It has not been proven they had either. It is like this company didn't exist except on paper.

We were caught up in the down economy and were forced to sell everything we could to pay off what we could and this money was part of our last savings dollars. We were working with another Broker and they recommended this company. This other company is of little or no help.

We filed a complaint with the Office of the Attorney General of Michigan and they wrote two letter to the company with no response. The Attorney General Office informed me by letter the act as a mediator in consumer -related issues, however, if our mediation is not successful we are unable to file suit on behalf of an individual. They can only provide legal opinions to state officials, etc. They suggested we consider private litigation.

We did hire an attorney from Michigan to look at this case and were informed the contract was specific and without the loan our deposit should be refunded. For a fee the attorney did write two letters with no response. He also investigated the address of Infinity Commercial Capital and it was a post box. There is no company building at this address. For more money which we don't have at this time he would continue to spend more time hiring a private investigator etc. We just don't have the money to do this.

This company is not what it appears on it's web site. Be very careful with your dealing because you could be next.

  I'm not sure where this complaint has originated from and it seems that there has been a significant mistake made by the person making this report. I am one of the partners and i have researched our books and records extensively and this file and client has never been engaged  or associated by our company nor is the noted information correct. There are several companies with the same name locally and nationwide and we are sorry that this has happen and wish the person better days and much success in the future.
