I signed a contract to build a home with Rick Greene aka Green Realty, aka Greene Consturction. Horry County code enforcement passed my home for occupancy with over 6 code violations. These included leaking windows, leaking basement (not a true basement, above ground two story home with dirt banked up to the front of it), deck that had no supports, exposed wiring etc. To date (two years later) I am still trying to get this person to complete his work. The South Carolina Builders Commission has done absolutely nothing whereas I have retained an attorney.

Rick Greene has filed bankruptcy and is hiding all his assetts. Discovery has not produced insurance that would cover his faulty workmanship.

I stand to lose quite a sum of money and I don't know what to do about it. My attorney is also at a loss.

MOST attorneys are "at a loss."

Unfortunately, most attorneys do not have the skill, experience, or MOTIVATION to handle a construction defect/breach of warranty case. The cases typically DO NOT alow the kind of large awards that some kinds of cases do. In some states you can't even recover your legal fees, making suing a losing proposition even if you WIN. Then you have to collect, and builders are quick to hide assets, declare bankruptcy, or just build under another corporation name. The courts do not offer practical, affordable legal recourse in most cases, no matter how valid and well substantiated your case is. Bad builders are getting away with more outrageous and damaging FRAUD all the time.

Part of the reason is home builders associations--they have millions to contribute to political campaigns and lobbying, and they literally pay to have our consumer protection laws gutted and/or unenforced.

Anyone that thinks home owners are suing builders left and right or profiting from it is either very ignorant or is supporting the builder. Builders are using scare tactics to convince home buyers that they won't be able to buy a home if strong laws are enforced on the builders. This is BULL. www.hadd.com

Rick Green, Green Realty, Green Construction complaint

I checked the SC Online Labor Licensing and Regulation board for ALL types of certification by typing in Green Realty, Green Construction, and Rick Green. I found the only Green Construction with the licensee listed as James Green, may or may not be the same company. But it is possible that a family could have the business listed in one person's name and another person running it.

I've been a licensed nurse. State boards perform background checks before issuing license on nursing. Nurses are held accountable by state licensing boards for their having a professional license to perform a service. So it should be the same for builders and realtors. By having a professional license you have certain guidelines you must adhere to. The state LLR board will have an investigator contact the owner of the business. If he does not want his business license revoked they might come to meet your satisfaction. I would check the SC Labor Licensing and Regulations board (LLR). You might need to call them and find out if the Green Construction listed is the same company as the one who built your house. You might want to file a complaint with the SC LLR Board on the Company on the individual in any case and keep good records of all documentation.

Also SC Legal Aid has attorneys who assist with consumer problems. You will have to call a toll free number and go through a little "rigamarole"; but once you get paperwork and a complaint in, they can recommend and/or assist you an attorney.

I'd definitely file a complaint with the Attorney General. This office handles consumer affairs.

Get a police report "for information only" and then go talk to a magistrate to try getting help. You can maybe file an arbitrary suit in court. Just make sure you have your Ps & Qs - paperwork (payments, pictures, etc) when you go to the police and/or magistrate.
