I have serious problems with Lowe¡¦s West Chandler store# 674 and Lowe¡¦s Monogram Credit Card Bank of Georgia. Lowe¡¦s had willfully and intentionally filed derogatory information to both my husband and my credit bureau files and Lowe¡¦s owes me money.
I have to provide Lowe¡¦s with a copy of the Fair Credit Billing Act from the Federal Trade Commission to prove to them that they were violating the Federal laws. Lowe¡¦s also employs every tactics possibly, including deception, false statement, false pretense, false promise and misrepresentation, to thwart my attempt to resolve problems.
Lowe's has not dealt fairly with me, nor are they unwilling to respond to my legitimate complaints. I got the runaround among Lowe¡¦s West Chandler store #674, Lowe¡¦s Customer Care and Lowe¡¦s Credit Card Department. I suffered great inconvenience, repeated annoyance and frustration, in addition to increased loss of time and money.
The problems began on May 28, 2000; I ordered kitchen cabinet material to be installed from Lowe¡¦s West Chandler Store #674. The cabinet designs by Lowe¡¦s were faulty and the cabinet installation took three or four different cabinet installers to complete the project.
The cabinet installation took 11 months - 8 months behind the schedule. There was an unauthorized charge of $ 2,127.89 on 06/20/2000 by Lowe¡¦s employee. Furthermore, there were numerous cabinets returned and exchanged. To make the matter worse, I was unable to get cooperation from Lowe¡¦s West Chandler to reconcile the cabinet charges on my Lowe¡¦s account.
Thus, I formally initiated the dispute of cabinet charges on 05/16/2001. And, pursuant to the suggestion of the Lowe¡¦s Customer Service @ (800) 444-1408, on 05/31/2001, I sent a payment of $29,951.72, which represented the entirety of my Lowe¡¦s account.
I included a letter explaining our calculation. Lowe¡¦s, however, continued to bill me a balance due for which I asked and requested for an explanation and clarification. As of 07/09/2003, Lowe¡¦s has not provided me with any explanation or clarification for charges of cabinets on our Lowe¡¦s credit card or the alleged balance due.
Below are some selected facts:
„« Lowe¡¦s fails to credit the returned merchandises for items pick up by Mr. Tom Rose @ Lowe¡¦s on 02/04/01. Lowe¡¦s fails to credit charges of cabinet that we didn¡¦t accept and were not installed. On 06/20/2000, Lowe¡¦s made an unauthorized charge of $2,127.89 on my Lowe¡¦s account and refused to credit back this charge.
„« I disputed my cabinet charges as of 05/16/2001. My account was current as of 06/01/2001. For more than 2 years, Lowe¡¦s has improperly filed derogatory reports of delinquency and bad debt charge-off of $2,953 to the credit bureaus files and attempted to collect the disputed amount by engaging two collection agencies : Jerold Kaplan Law Office, PC and Wolpoff & Abramson, LLP
„« Lowe¡¦s alleged there is a bad debt discharged of 2,953 on my Lowe¡¦s account. But, Lowe¡¦s has not been unable to provide the proof of such a debt. In fact, I have asked Mr. Kevin Miller, Store Manager of Lowe¡¦s #674, whether he could provide me with the detail of charges on Lowe¡¦s claims. He said ¡§NO!¡¨ As of 07/09/2003, I¡¦m still going after Lowe¡¦s to correct our credit reports problems. What a shame!!!!!
„« Lowe¡¦s owes me money since Lowe¡¦s failed to accept my payment of 05/31/2001 as its entirety. As of 01/03/2002, I have provided Lowe¡¦s with the preliminary calculation for the money Lowe¡¦s owes me. I have requested refund on my Lowe¡¦s account as of 01/03/2002 and I have yet to receive the refund from Lowe¡¦s.
„« Lowe¡¦s refused my offer made on 05/21/2003 ¡V Credit $245.47 to my Lowe¡¦s account and update our credit reports within a week. It was my understanding from Mr. Kevin Miller that he was willing to credit $245.47 to my Lowe¡¦s account, but, Lowe¡¦s Credit Card Department would not remove our bad credit reports because there was a bad debt written of $2,953 on my account. I asked Mr. Miller whether he could provide me with proof of bad debt $2,953. He replied ¡§NO.¡¨
„« Lowe¡¦s finally could not lie about the bad debt written of $2,953 on my Lowe¡¦s account. On 05/30/2003, I provided Mr. Kevin Miller and his credit specialist with a copy of Fair Credit Billing Act. I met and provided Mr. Miller and his credit specialist each a 27-page document. The three of us spent two hours discuss and reconcile the charges on my Lowe¡¦s account.
„« To my dismay, Mr. Kevin Miller told me that Lowe¡¦s system was operated in such a way that when he credited $245.47 to my account, the previous written off $2,953 automatically popup. Accordingly, he requested that I agree to make cash payment (phantom) of $2,953 on 05/30/2003 even if I do not have paid for it.
„« With today¡¦s current technologies, I was perplexed as to why Lowe¡¦s was not equipped to handle its billing error entries or adjustments. It appears that the conduct of Mr. Kevin Miller was acted in deception, false pretense and misrepresentation of material facts ¡V consumer fraud. It was my understanding from Mr. Kevin Miller that he was working with Ms. Karen, Recovery center of Lowe¡¦s Credit Department.
„« On 06/05/2003, through Lowe¡¦s Customer Care, I requested refund on my account and again was ignored. Accordingly, Billy, Lowe¡¦s Customer Care, forwarded my request to senior management.
„« I waited and waited for my refund. Twenty-five days later, on 06/30/2003, I informed Billy that if I do not hearing back form Lowe¡¦s about my refund, I¡¦ll file Rip-off Report against Lowe¡¦s. Then, Mr. Kevin Miller called and said that he had fixed our credit reports and that he had consulted with Lowe¡¦s Legal Department and Lowe¡¦s Customer Care about the matters.
„« Accordingly, the matters with my Lowe¡¦s credit card account were closed. Mr. Kevin Miller provided false promises about my refund claims. First, on 05/24/2003, he agreed to credit$257 to my account. Then, on 05/28/2003, he further agreed that I could claim additional refund if I met with him and his credit specialist to reconcile my cabinet charges.
„« I filed the Rip-off Report against Lowe¡¦s on 06/30/2003 after Mr. Kevin Miller¡¦s made the remark about the matters on my account were closed.
JUST EXACTULLY WHAT IS WRONG WITH LOWE¡¦S!!! WE CANNOT LET LOWE¡¦S GET AWAY WITH IT!!!
Lowe¡¦s still us owes money on our Lowe¡¦s credit card account. Lowe¡¦s still has not acted in good faith to correct our credit report records. I want Lowe¡¦s to compensate us for inconvenience that Lowe¡¦s has caused us, such as hours spent on disputed process, damages on derogatory credit bureau files, transportation, business lost in dollar and aggravation & stress.
07/03/2003, I finally contacted Mr. Robert Livingston Tillman, Chairman and CEO in the hope that he could break through a logjam. Instead, I get transferred from one staff to another, but so far nobody¡¦s willing to admit that this problem falls within his or her purview. On 07/08/2003, it was my understanding from Mr. Richardson, staff of Lowe¡¦s corporate office at NC, that those corporate officers do not know anything about laws; thus, they will not respond to my complaints about Lowe¡¦s violating the law.
Accordingly, I should not expect to hear from those corporate officers. In Particular, Mr. Richardson told me that Ann, Lowe¡¦s Senior Manager of Credit Card Department, spoke to me on 06/07/2003 and she noted on file that Lowe¡¦s has written off the our delinquent balance on 06/04/2003.
I told Mr. Richardson he should know that Ann¡¦s notes about the written off the delinquent balance on my Lowe¡¦s account were a very serious false statement ¡V consumer fraud. In other word, Ann¡¦s note stated that she had written-off the bad-debt on my account.
Clearly, Ann, as a senior manager of Lowe¡¦s credit card department, knew or should have known there was no delinquent balance or bad debt on my Lowe¡¦s account. Instated, Lowe¡¦s violated the Federal law - committed the billing errors on my Lowe¡¦s account and, inappropriately, damaged our credit reports.
With Lowe¡¦s that proves unwilling to respond to legitimate complaint, we have contacted a consumer advocate from the badbusinessbureau.com whom I will be employed to assist the picketing activity in front the West Chandler Store #674 and its parking lot until the issue is resolved. The picket is scheduled to begin at 10 am on 07/12/2003.
