Rob Malins from Zumaya Flooring is a scam artist.  Rob took a $25,000.00 dollar deposit and never provided the flooring he was contracted to provide. Rob Malins is a criminal and not to be trusted.

Rob Malins is no scam artist, nor a criminal! This is the situation...

I am the Founder and President of Zumaya Inc. My company took a $25,000 deposit on a hardwood flooring purchase from the Complainant's Company.  We proceeded to pay a deposit to a Chinese Factory who was hired to produce the flooring ordered.  This Factory has since folded during the world economic crisis, taking Zumaya's deposit with them. Due to the effect of the economy on Zumaya (we have very elevated accounts receivable levels compared to previous periods) we have been unable to quickly come up with the extra $25,000. from our free cash flow in order to repay the Claimant. I do fully intend to repay this debt over time.

The Complainant has filed a complaint with the Superior Court of California, Los Angeles District, which Zumaya has answered and will participate in.  The Complainant and I are in negotiations concerning a repayment plan I am offering as a full resolution to this problem. 

Now as to the allegations that I am a "scam artist" and a "criminal".  I have been in business for 25 years, and have taken in tens of millions of dollars in customer deposits during this time.  Not one Customer Deposit has been lost, nor a contract unfulfilled up until the time of this current situation.  And I have no criminal record whatsoever, never have, and never will.  So the allegations of "scam artist" and "criminal" are untrue, and are in fact libelous allegations, and are an irrational overreaction to the situation as it is. 

I had offered a resolution to the problem to the Complainant.  I had access to a product whose specifications were identical to the original product, which the Chinese Factory failed to produce. I presented this alternative, which I was able to provide in order to fulfill my obligations under the contract.  I was informed that a committee of five Interior Designers would be deciding on the replacement product's suitability.  I knew from this that concensus would never be reached from such a committee (Interior Designers can be very difficult to please, let alone five Interior Designers), and that I would be prevented from fulfilling my part of the contract with an equal product.

Malins begins to pay back deposit 1 yr 5 mos later

Rob Malins has now begun to pay back the $25,000 deposit he took from me in May of 2009.  It is now Oct of 2010, 1 yr and 5 mos later.  Malins pay back at this point is approximately $900/mo.  I will report back on Malins adherance to this pay back plan.

“Rob Malins and Zumaya have entered into a repayment program honorably and we have received a very substantial initial payment. It appears at this juncture that Mr. Malins and Zumaya have every intention of paying their debts to J.T. Structures in full”
