had to research the addrss and phone number from other posts but here is the deal.

Cardboard mailer arrives for my wife with name mispelled on it. Looks like one of those AOL mailers which we keep the nice box for dvd storage and toss the disk =) The mailer doesnt say anything on it who its from. Wife opens it and finds a CD in it for something she nor I would never listen to. Not sure how they got the address, spyware? But obviously with name incorrect they got it ilegitimately. Inside was a bill for cd, with demands for payment. Cds overpriced, each bill another $10 gets added for late fees with threats of reporting to credit agency and so forth. Cant see how that possable, they dont have her correct name I seriousely doubt they have her SS# which is required to make a report in first place. Quite obviouse this whole scam is to lure people into paying for what they never ordered and make BMG music illigally.

BTW, its come to the fact that the US postal service nor authorites enforce laws about this as I had tried to report it and get a run around from both.

What did you do with the CDs?

Since it was obviously an "error," did you return the CDs? BMG will credit any unwanted CDs as long as you mark the package "return to sender." If, however, you chose to keep the CDs, then you must pay for them as they are NOT free.

As for whether or not this constitutes fraudulent activity, request the original agreement form from BMG so you can see who exactly signed up and/or forged your signature. Also you can contact the credit bureaus to see if the account was opened under your or your wife's social security number, and also if this has been reflected negatively on your credit.

The name may be misspelled, but why would anyone forge your wife's name/signature to open an account and then have the CDs shipped to YOUR house? There just isn't any sense to that.

In case you didnt read above, it was 1 CD with no information on the package other then person its to. Us postal service will not return an opened package/letter. They may forward it to a correct adress if the adres was wrong. Nothing what so ever stated my wifes name was forged, only that BMG sent the CD along with billing and rules inside the case in a poor attempt using her name. We get lots of junkmail, its very easy for them to have obtained info, incorrect at that from anywhere. Lastly, you are not familier with federal lar in regards to mail. If any company or individual sends you something you did nor order in an attempt to make a sale, they forfeit their right and the item is the recievers. You can check that with any postal service, any person from consumer affairs. Since there was never any corospondance ordering the item, phone, mail, email it is obviouse its a poor attempt to make a sale.

Far as credit report goes, nothing on it showing BMG or any other false use. There is one other thing though, which ill post shortly, is that one other item came in the mail with same incorrect spelling attempting to get bank information and SS# to comit credit fraud as you might have suggested. Fact neither has my wifes correct name or SS# and fact that there are other listings on this website for same or similar incidents says enough.

Lastly, of the three bills they sent which had no information on it like the CD, a message was sent in their return envelope to send a return lable so they can have the CD back. Its not wanted and as I said above if it was she doesnt have to return it since they sent it to her without asking or contract.

BMG lowered my credit score....

if you had been a victim of identity theft. i presume the person who would have committed this crime against you would've done ALOT more than set you up with a cd club. it was not caused by "spyware" or the planets aligning...or really anything other than either one of your neighbours, one of your (if you have them) kids ordered something. you may have also filled out a survey that asks you to pick a cd and a number of other things to get a gift card or an ipod or something.

as for reporting you to a credit reporting agency, they can't really unless you have the world's most unique name. now if a cd came in the mail from them..and i didn't order it. i certainly wouldn't OPEN THE PACKAGING. i would simply write "RETURN TO SENDER" or "REFUSED" on the package and send it back.

my only other theory on this is, if you are a member of BMG, you probably didn't respond to the selection of the month. it gets sent out to you automatically.
in either case, ANY TIME YOU RECEIVE A STRANGE/UNKNOWN PACKAGE, DO NOT OPEN IT. SEND IT BACK!
